BILL NUMBER: SB 943 CHAPTERED 09/26/07 CHAPTER 228 FILED WITH SECRETARY OF STATE SEPTEMBER 26, 2007 APPROVED BY GOVERNOR SEPTEMBER 26, 2007 PASSED THE SENATE SEPTEMBER 12, 2007 PASSED THE ASSEMBLY SEPTEMBER 11, 2007 AMENDED IN ASSEMBLY SEPTEMBER 6, 2007 AMENDED IN SENATE APRIL 30, 2007 INTRODUCED BY Senator Machado FEBRUARY 23, 2007 An act to add Section 6275 to the Penal Code, relating to prisons. LEGISLATIVE COUNSEL'S DIGEST SB 943, Machado. Prisons. Existing law authorized the construction of a medium security prison for women, currently known as the Northern California Women's Facility, and prohibited the housing of male inmates in that prison. This bill would authorize the use of the Northern California Women' s Facility as a reentry facility to house inmates, parole violators, or parolees pending revocation of parole, as specified. Existing law requires the Department of Corrections and Rehabilitation to give funding preference to counties that assist the state in siting reentry facilities. This bill would provide that San Joaquin County and the City of Stockton sited and assisted the state in siting reentry facilities when they passed resolutions supporting the conversion of the former Northern California Women's Facility to a reentry facility, as specified. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 6275 is added to the Penal Code, to read: 6275. (a) Notwithstanding any other provision of law, the Department of Corrections and Rehabilitation is authorized to use the Northern California Women's Facility in Stockton as a reentry facility to house inmates, parole violators, or parolees pending revocation of their parole who are either paroling to, or returning to prison from, the Counties of San Joaquin, Calaveras, or Amador. (b) The provisions of subdivision (b) of Section 15820.907 of the Government Code were met on August 7, 2007, when the San Joaquin County Board of Supervisors and the Stockton City Council passed resolutions supporting conversion of the former Northern California Women's Facility to a reentry facility to house male inmates or parole violators. (c) The "reactivation" of the Northern California Women's Facility for use as a reentry facility to house male inmates shall have the same meaning and legal definition as the following terms: (1) "Assist the state in siting" as provided in subdivision (b) of Section 15820.907 of the Government Code.
