SENATOR ALAN LOWENTHAL, CHAIRMAN AUTHOR: ASM Trans
VERSION: 6/30/09
Analysis by: Mark Stivers FISCAL: Yes
Hearing date: July 7, 2009
SUBJECT:
Transportation omnibus bill
DESCRIPTION:
This bill makes non-controversial changes to sections of law
relating to transportation
ANALYSIS:
According to the Legislative Analyst, the cost of producing a
bill in 2001-02 was $17,890. By combining multiple matters into
one bill, the Legislature can make minor changes to law in a
cost-effective manner.
This bill makes non-controversial changes to sections of law
relating to transportation. Specifically, the bill includes the
following provisions. The requestor of each provision is noted
in brackets.
Requires that any interest or other return that cities and
counties earn from the investment of their allocation of local
street and road funds under Proposition 1B bond funds be used
for improvements to transportation facilities. [State
Controller John Chiang]
Corrects a mistaken cross-reference related to the conditions
under which a district may use the design-build method of
procurement. [Sacramento Regional Transit]
Allows transit operators to file annual reports with the
applicable transportation planning agencies and the

Controller's office within 110 days of the end of the fiscal
year, as opposed to the standard 90 days, if they file the
reports in an electronic format prescribed by the Controller.
[State Controller John Chiang]
Clarifies that organ donors may limit the use of their
donations strictly for research purposes. [Donate Life
California]
Corrects a typographical error in a Vehicle Code section
dealing with the impoundment of vehicles being used as taxi
cabs in violation of taxi cab licensing requirements.
[Legislative Counsel]
Adds water corporations, sewer system corporations, and local
agencies or joint powers agencies providing sewer service, gas
service, water service, or wastewater service to the list of
utilities that may use mobile digital equipment in the front
seat if the display has an opaque covering that does not allow
the driver to view it while driving. [California Municipal
Utilities Association]
COMMENTS:
1.Purpose of the bill . The Assembly Transportation Committee is
authoring this bill as a means of combining multiple,
non-controversial changes to statutes into one bill, so that
the Legislature can make minor amendments in a cost-effective
manner. There is no known opposition to any item in the bill,
and if concerns arise that cannot be resolved, the provision
of concern will be deleted from the bill.
2.Previous legislation . Many of the items in this bill were
included in last year's omnibus bill, AB 3064 (Assembly
Transportation Committee). Governor Schwarzenegger vetoed AB
3064, stating:
The historic delay in passing the 2008-2009 State Budget
has forced me to prioritize the bills sent to my desk at
the end of the year's legislative session. Given the
delay, I am only signing bills that are the highest
priority for California. This bill does not meet that
standard and I cannot sign it at this time.
3.Technical amendment . On page 14, lines 29-30 strike
"determined pursuant to" and insert "subject to the conditions
