SUBJECT : Transportation omnibus bill

DIGEST : This bill makes non-controversial changes to
sections of law relating to transportation.
ANALYSIS : This bill makes non-controversial changes to
sections of law relating to transportation. Specifically,
this bill includes the following provisions:
1. Requires that any interest or other return that cities
and counties earn from the investment of their
allocation of local street and road funds under
Proposition 1B bond funds be used for improvements to
transportation facilities.

2. Corrects a mistaken cross-reference related to the
conditions under which a district may use the
design-build method of procurement.
3. Allows transit operators to file annual reports with the
applicable transportation planning agencies and the
State Controller's Office within 110 days of the end of
the fiscal year, as opposed to the standard 90 days, if
they file the reports in an electronic format prescribed
by the State Controller.
4. Clarifies that organ donors may limit the use of their
donations strictly for research purposes.
5. Corrects a typographical error in a Vehicle Code section
dealing with the impoundment of vehicles being used as
taxi cabs in violation of taxi cab licensing
requirements.'
6. Adds water corporations, sewer system corporations, and
local agencies or joint powers agencies providing sewer
service, gas service, water service, or wastewater
service to the list of utilities that may use mobile
digital equipment in the front seat if the display has
an opaque covering that does not allow the driver to
view it while driving.
Comments
Purpose of the bill . The Assembly Transportation Committee
is authoring this bill as a means of combining multiple,
non-controversial changes to statutes into one bill, so
that the Legislature can make minor amendments in a
cost-effective manner. There is no known opposition to any
item in the bill, and if concerns arise that cannot be
resolved, the provision of concern will be deleted from the
bill.
Prior legislation . Many of the items in this bill were
included in last year's omnibus bill, AB 3064 (Assembly
Transportation Committee). Governor Schwarzenegger vetoed
AB 3064, stating: "The historic delay in passing the
2008-2009 State Budget has forced me to prioritize the

bills sent to my desk at the end of the year's legislative
session. Given the delay, I am only signing bills that are
the highest priority for California. This bill does not
meet that standard and I cannot sign it at this time."
