          CONCURRENCE IN SENATE AMENDMENTS

           SUMMARY  :  Enacts several noncontroversial amendments to  
          transportation-related statutes.  
           
          The Senate amendments  :  

          1)Correct an erroneous cross-reference in the Public Contract  
            Code regarding the authority of transit operators to award  
            design-build contracts and provide more precise terminology  
            for the determination of the price of those projects.  

          2)Delete language that would add municipal public safety  
            agencies to those entities that may operate a "school pupil  
            activity bus" so that they may use their buses for school  
            programs.  

          3)Assure that this bill will not "chapter out" AB 62  
            (Portantino), Chapter 73, Statutes of 2009, regarding video  
            screens in the front seats of vehicles, or any other bill from  
            this year's legislative session that deals with the  
            impoundment of taxicabs.  
           
          EXISTING LAW  includes numerous technical provisions dealing with  
          various transportation issues.  
           
          AS PASSED BY THE ASSEMBLY  , this bill:

          1)Required interest earnings from the investment of Proposition  
            1B bond funds to be subject to the same restrictions as the  
            bond proceeds themselves.  

          2)Conformed the Public Utilities Code to the Government Code in  
            regard to the time by which transit operators must file annual  
            reports with the California State Controller's office.

          3)Added municipal public safety agencies to those entities that  
            may operate a "school pupil activity bus" so that they may use  
            their buses for school programs.  

          4)Clarified that organ donors may limit the use of their  
            donations strictly for research purposes.  

          5)Corrected a typographical error in a Vehicle Code section  
            dealing with the impoundment of vehicles being used as taxi  
            cabs in violation of taxi cab licensing requirements.  

          6)Added water agencies and local-government providers of gas  
            services to the list of utilities that may use mobile digital  
            equipment in the front seat if the display has an opaque  
            covering that does not allow the driver to view it while  
            driving.  

           FISCAL EFFECT  :  According to the Assembly Appropriations  
          Committee, no direct state fiscal effect.  
           COMMENTS  :  The Transportation Committee annually authors an  
          "omnibus bill," combining various technical statutory "fixes"  
          brought to it by agencies and individuals that deal with  
          transportation issues.  Last year's omnibus bill, AB 3064, while  
          being a consent item throughout the legislative process and  
          having no opposition, was nevertheless vetoed by the Governor  
          with what became a common 2008 veto message: "The historic delay  
          in passing the 2008-2009 State Budget has forced me to  
          prioritize the bills sent to my desk at the end of the year's  
          legislative session.  Given the delay, I am only signing bills  
          that are the highest priority for California.  This bill does  
          not meet that standard and I cannot sign it at this time."  

          AB 282 contains many, but not all, of the provisions that were  
          included in the vetoed AB 3064.  As with AB 3064, it is not  
          anticipated that any of these provisions will attract any  
          opposition.  The bill's various provisions are sponsored by  
          entities such as the State Controller, Donate Life California,  
          Legislative Counsel, and the California Municipal Utilities  
          Association.
