   An act to add Sections 60200.7 and 60200.8 to the Education Code,
relating to instructional materials.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 482, as amended, Mendoza. Instructional materials: English
learners.
   Existing law requires the State Board of Education to adopt
regulations concerning the development of curriculum frameworks and
the adoption of instructional materials.
   This bill would state the intent of the Legislature to provide
school districts with quality instructional materials written and
taught in the English language to accelerate English language
acquisition for English learners while upholding and teaching
California's English language arts content standards. The bill would
require the state board by December 31, 2013, to revise the
reading/language arts framework to include the English Language
 Development  Literacy Program  for English
Learners  , a basic comprehensive English language literacy
program for English learners, that would meet specified requirements
and be aligned to both the  reading/language  
English/language  arts content standards and the English
language development standards adopted by the state board. The bill
would require the evaluation criteria and  worksheets
  standards maps  for the revised framework to be
modified, as specified.
   The bill would require, commencing with the 2010 followup adoption
of instructional materials for reading/language arts/English
language development, and for each primary and followup adoption of
instructional materials for reading/language arts/English language
development thereafter, that the  State Board of Education
assure   state board ensure  and document that the
individuals on the panels for the instructional  material
  materials  review and content review meet the
specified requirements.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  The Legislature hereby finds and declares the
following:
   (a) It is the intent of the Legislature that school districts be
provided with as many standards aligned instructional material
options as is possible so that educators may have a selection of the
best instructional materials to choose from in order for their pupils
to master the state academic content standards.
   (b) It also is the intent of the Legislature that the state's 1.6
million English learners acquire English as quickly as possible and
to assist in the narrowing of the academic achievement gap between
English learners and their native English speaking peers. To
accomplish this, it is the intent of the Legislature to provide
school districts with quality instructional materials written and
taught in the English language to accelerate English language
acquisition for English learners while upholding and teaching the
state English language arts content standards.
  SEC. 2.  Section 60200.7 is added to the Education Code, to read:
   60200.7.  (a) (1) By December 31, 2013, the state board shall
revise the reading/language arts framework to include a basic
comprehensive English language literacy program for English learners
that shall be referred to as the English Language 
Development  Literacy Program  for English Learners
 and meet all of the following requirements:
   (A) The program shall be a stand-alone core program that is
enriched, scaffolded, and amplified, and shall simultaneously develop
listening, speaking, reading, and writing skills in the English
language and the academic content standards.
   (B) The program shall be aligned to both the 
reading/language   English/language  arts content
standards adopted under Section 60605 and the English language
development standards adopted under Section 60811. 
   (C) The program criteria shall constitute a chapter in the revised
reading/language arts framework.  
   (2) The revision required pursuant to this subdivision shall
include a revision of Chapter 7 of the reading and language arts
framework, "Universal Access to the Language Arts Curriculum," in
order to reflect the new English Language Development Literacy
Program.  
   (2) Criteria for evaluating instructional materials for the
English Language Literacy Program for English Learners shall be
included in the revised reading/language arts framework. 
   (b) By July 1, 2014, the evaluation criteria and 
worksheets   standards maps  developed for the
revised  reading/English language  
reading/language  arts framework shall do all of the following:
   (1) Include the English language development standards adopted by
the state board pursuant to Section 60811.
   (2) Include the English language arts content standards adopted by
the state board pursuant to Section 60605.
   (3) Provide clear direction to publishers regarding the English
Language  Development  Literacy Program  for
English Learners  . 
   (c) The standards maps distributed to publishers by the department
shall include the English Language Arts and English Language
Development Standards.  
   (d) The 2015 adoption process for reading/English language arts
that is based on the framework revised pursuant to this section shall
use, to the extent possible, the "invitation to submit" document
used in the 2008 reading/English language arts/English language
development primary adoption and evaluation, and criteria that are
revised as specified in subdivision (b).  
   (e) 
    (d)  Instructional materials adopted by the state board
that are based on the framework revised pursuant to this section
shall be placed on the list of basic reading/language arts
instructional materials and remain on the list until the established
expiration date for that list.
   SEC. 2.   SEC. 3.   Section 60200.8 is
added to the Education Code, to read:
   60200.8.  Commencing with the 2010 followup adoption of
instructional materials for reading/language arts/English language
development, and for each primary and  follow up 
 followup  adoption of instructional materials for
reading/language arts/English language development thereafter, the
state board shall  assure   ensure  and
document that the panels for the instructional  material
  materials  review and content review meet the
following requirements:
   (a) Fifty percent of a panel that reviews and evaluates
instructional materials that provide English language development
instruction and are aligned to the English language arts/English
language development matrix shall be individuals who meet the
following criteria:
   (1) Possess expertise and have experience teaching English
language development to pupils.
   (2) Have been trained on validating the alignment of the English
language development standards and English language arts standards
with instructional materials submitted for adoption by the state
board.
   (3) Have been trained on  research based  
research-based  attributes of high-quality English language
development instruction.
   (b) Seventy-five percent of a panel that reviews and evaluates
reading intervention materials written specifically for English
learners shall be individuals who meet the following criteria:
   (1) Possess expertise and have experience working with English
learners in grades 4 to 8, inclusive.
   (2) Have been trained on  research based  
research-based  attributes of reading intervention instruction
for English learners.
