BILL ANALYSIS AB 759 Page 1 Date of Hearing: May 13, 2009 ASSEMBLY COMMITTEE ON APPROPRIATIONS Kevin De Leon, Chair AB 759 (Ma) - As Amended: April 14, 2009 Policy Committee: Business and Professions Vote: 7-4 Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill modifies information the Department of General Services (DGS) is required to report regarding the level of participation in state contracts of business enterprises by race, ethnicity, and gender of the owner, to the extent such information is voluntarily reported to the department. Specifically, this bill: 1)Requires, in addition to the existing categories of (1) construction, (2) purchase of materials, supplies, or equipment, and (3) professional services, that participation in contracts in the following categories be reported: a) Architectural, engineering, and other professional services. b) Information technology procurements. 2)Requires that the report include the dollar value of all contract in the categories described in (1). FISCAL EFFECT Minor annual special fund costs (around $30,000) to DGS for the additional reporting requirements. AB 759 Page 2 COMMENTS Purpose . According to the author's office, this bill allows the state to better assess the participation rate and goals of women or minority-owned businesses in statewide contracting. Current law requires DGS to report on the participation in state contracts of disabled veterans business enterprises according to the same categories specified in this bill.
