   An act to add Section 27389 to the Government Code, relating to
records.

   AB 827, as introduced, Yamada. Records.
   Existing law requires the county recorder to charge and collect
certain fees for the filing or recording of various property-related
instruments, papers, or notices.
   This bill would authorize the Board of Supervisors of Yolo County
to charge an additional fee for the filing or recording of any
property-related instrument, paper, or notice by the county recorder.
The bill would require funds generated by the fee to be used for the
sole purpose of maintaining and preserving the county's document
storage system.
   The bill would state the findings and declarations of the
Legislature concerning the need for special legislation.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 27389 is added to the Government Code, to read:

   27389.  Notwithstanding any other provision of law, the Board of
Supervisors of Yolo County may charge an additional fee for the
filing or recording of any property-related instrument, paper, or
notice by the county recorder to be set at the level required to
offset the cost to maintain and preserve the documents filed or
recorded. The funds generated by this additional fee shall be used
for the sole purpose of maintaining and preserving the county's
document storage system.
  SEC. 2.  The Legislature finds and declares that a special law is
necessary and that a general law cannot be made applicable within the
meaning of Section 16 of Article IV of the California Constitution
because of unique circumstances pertaining to the costs of
maintaining and preserving Yolo County's document storage system.
