SUMMARY : Enacts the Donda West Law, which would prohibit
elective cosmetic surgery on a patient unless, prior to surgery,
the patient has received a physical examination and clearance
for surgery, as specified.
The Senate amendments :
1)Specify that an elective cosmetic surgery procedure may not be
performed on a patient unless the patient has received, within
30 days prior to the surgery, an appropriate physical
examination, as specified, and confirmed as up-to-date on the
day of the procedure.
2)State that an appropriate medical history and physical
examination done on the day of the procedure will be presumed
to be in compliance with this bill's requirements.
3)Define "elective cosmetic surgery" as an elective surgery that
is performed to alter or reshape normal structures of the body
in order to improve the patient's appearance, including, but
not limited to, liposuction and elective facial cosmetic
surgery.
4)Make technical and clarifying changes.
AS PASSED BY THE ASSEMBLY , this bill was substantially similar
to the version passed by the Senate.
FISCAL EFFECT : Unknown. This bill is keyed non-fiscal.
