ANALYSIS : Existing law allows a local agency formation commission (LAFCO) to initiate proposals for changes or organization, including consolidation. CONTINUED AB 1232 Page 2 The procedures for boundary changes require four, but sometimes five, steps: 1. Initiation and filing a detailed application with LAFCO. 2. LAFCO review and approval, after public notice and hearing. 3. Another public hearing by LAFCO to measure protests. 4. An election, if there were significant protest. 5. Completion of the formal documents. For most special districts, there are three ways to propose a consolidation or reorganization: 1. A petition signed by five percent of the registered voters in each district. 2. A resolution adopted by any local agency that contains territory in any of the districts. 3. A resolution adopted by the LAFCO. This bill authorizes the Marin County LAFCO to initiate and approve a reorganization or consolidation of the Sewerage Agency of Southern Marin and its member agencies, without protest hearings. This bill allows the Marin County LAFCO to impose terms and conditions on this reorganization or consolidation that requires the Sewerage Agency of Southern Marin and its member agencies to pay for the commission's costs. This bill's provisions become effective on January 1, 2011. This bill contains extensive legislative findings and declarations in support of its provision. The bill contains a statement justifying its special provisions. Baykeeper has been working to rein in the Bay's sewage spill problem for over a decade, calling for a region-wide upgrade to failing sewage systems and compelling cities and sanitation agencies to reduce illegal spills. Clean Water Action works to address water quality issues in the Bay caused by persistent overflows. AB 1232 would help reduce sewage spills in the Bay by authorizing the consolidation of myriad small wastewater agencies into fewer and more efficient wastewater collection and treatment agencies."
