To the Members of the California State Assembly:

I am returning Assembly Bill 1834 without my signature.

This bill establishes the Rainwater Capture Act of 2010 to allow
landowners to install and operate "rainwater capture systems" for
saving water, for landscaping or infiltrating into the aquifer
beneath their property.  The bill would also include rainwater
recapture systems for eligibility under the Property Assessed Clean
Energy (PACE) Program.

The PACE programs authorized under current law provide property
owners with a cost-effective and easily accessible financing option
in which to increase their property's renewable energy generation, as
well as reduce their energy use and green house gas emissions.

While I believe other parts of this bill have some merit, I do not
support expanding the PACE Program to make it a financing option for
rainwater capture systems.   Furthermore, as this bill's own
legislative findings suggest, further work needs to be done to
explore relevant legal, policy, and technical issues pertaining to
rainwater and storm water capture before state policymakers consider
the appropriateness of pursuing state-sanctioned creative financing
options aimed at making rainwater recapture systems more affordable
and accessible to property owners on a wide scale.

For these reasons, I am unable sign this bill.
