   An act to  amend Section 19576 of   add
Section 19549.8 to  the Business and Professions Code, relating
to horse racing.

   AB 2201, as amended, Coto. Horse racing:  audio or video
recording.   harness racing: California Exposition and
State Fair.  
   Existing law provides that the California Horse Racing Board shall
have the authority to allocate racing weeks and provides that the
maximum number of racing weeks that may be allocated for harness
racing, other than at fairs, in the northern zone is 25 weeks per
year. Existing law also provides that the maximum number of racing
weeks that may be allocated to a fair shall be 4 weeks each year,
except as provided, including that the board may allocate additional
weeks of harness racing to the California Exposition and State Fair
in Sacramento or its lessee, to be raced at that fair.  
   This bill would provide that in the event the California
Exposition and State Fair in Sacramento is not available for harness
racing, or chooses not to conduct harness racing, in any given year,
then 52 weeks of harness racing shall be available that year to any
racing venue in the northern zone, subject to allocation by the
board.  
   Existing law prohibits a person from furnishing to another person,
and from using, an audio or video recording of any quarter horse
race occurring in this state for any commercial purpose without
permission from the racing association conducting the meeting, the
organization representing horsemen and horsewomen participating in
the meeting, and the California Horse Racing Board. 

   This bill would make technical, nonsubstantive changes to those
provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 19549.8 is added to the 
 Business and Professions Code   , to read:  
   19549.8.  In the event the California Exposition and State Fair in
Sacramento is not available for harness racing, or chooses not to
conduct harness racing, in any given year, then 52 weeks of harness
racing shall be available that year to any racing venue in the
northern zone, subject to allocation by the board.  
  SECTION 1.    Section 19576 of the Business and
Professions Code is amended to read:
   19576.  (a) No person may furnish an audio or video recording of a
quarter horse race occurring in this state to any other person
either within or outside of the state for any commercial purpose,
including the use of the recording in any type of video game, without
first securing the consent of the racing association conducting the
meeting, the organization representing horsemen and horsewomen
participating in the meeting, and the board.
   (b) No person may use any audio or video recording of a quarter
horse race occurring in this state for any commercial purpose without
first securing the consent of the racing association holding the
meeting, the organization representing horsemen and horsewomen
participating in the meeting, and the board.
   (c) Any person whose consent is required under this section may
file and maintain an action in superior court to obtain an injunction
against the furnishing or commercial use of a recording of a quarter
horse race in violation of this section.
