CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Codifies the Governor's Reorganization Plan No. 1 of
2009 (GRP 1), and makes related changes to government
information technology (IT) coordination and use.
The Senate amendments :
1)Change the Office of the State Chief Information Officer
(OCIO) to the California Technology Agency (CTA), and the
position of the State Chief Information Officer (SCIO) to the
Secretary of California Technology (SCT).
2)Extend the sunset date on the OCIO to January 1, 2015.
3)Transfer the Department of Technology Services from the State
and Consumer Services Agency to the CTA.
4)Clarify that any balance remaining in excess of 25% which is
used for the support of the data center and other client
services shall be used to reduce billing rates.
5)Require SCT to supervise CTA.
6)Permit CTA to revoke or reduce the authority for state
agencies to initiate information technology projects or
acquire IT or telecommunications goods or services.
7)Require CTA to improve the governance and implementation of IT
by standardizing reporting relationships, roles, and
responsibilities for setting IT priorities.
8)Require each state agency and entity, as specified, to have a
chief information officer (CIO), appointed as specified.

9)Permits a state entity that is not explicitly included in the
definition of a "state entity" to voluntarily comply with the
technology requirements and request assistance from CTA.
10)Outline the CIOs' duties.
11)Require each state agency and entity to submit, as instructed
by CTA, a summary of its actual and projected IT and
telecommunications costs, including personnel, for the
immediately preceding fiscal year and current fiscal year,
showing current expenses and projected expenses for the
current fiscal year, as specified, on or before February 1,
2011, and annually thereafter.
12)Set IT requirements for state agencies or entities.
13)Require CTA to include quarterly reports on its Internet Web
site.
14)Delete the requirement that the Office of Privacy Protection
(OPP) investigates and assist in the prosecution of identity
theft and other privacy-related crimes, and coordinate with
local, state, and federal law enforcement agencies in the
investigation of similar crimes.
15)Require the Public Safety Communications Division (Division)
to oversee radio transmitting devices owned or operated by
state agencies and departments, public safety communications
systems and facilities, and microwave communications systems
operated by the state, except microwave equipment used
exclusively for traffic signal and signing control, traffic
metering, and roadway surveillance systems, as specified.
16)Require all information technology requests for proposals
(RFPs) be reviewed by CTA and DGS, instead of the Office of
Legal Services prior to release.
17)Require the Public Utilities Commission to consult with the
California Emergency Management Agency and the CTA regarding
communications and alert systems.
18)Requires the Department of General Services, in consultation
with CTA, to develop, implement, and maintain standardized
methods for the development of IT RFPs.

19)Make technical and conforming changes.
AS PASSED BY THE ASSEMBLY , this bill codified GRP 1 and deleted
the provisions repealing the provisions establishing the office
of the SCIO, thus allowing those provisions to continue in
effect indefinitely.
FISCAL EFFECT : According to the Senate Appropriations
Committee, pursuant to Senate Rule 28.8, negligible state costs.
COMMENTS : This bill is substantially similar to the version
approved by the Assembly.
