SUMMARY : Recasts and clarifies the laws that govern the
procedures and criteria that determine the titles or
designations that insurance agents and brokers may use to
describe themselves in connection with the sale of insurance
products to senior citizens.
The Senate amendments :
1)Clarify that educational materials associated with specialty
designations cannot include marketing or other material
designed to enhance the volume of sales of insurance products.
2)Delete provisions that would have established a mechanism for
non-qualifying programs to nonetheless obtain certification.
3)Make several clarifying and redrafting changes to effectuate
the original intent of the bill.
EXISTING LAW generally regulates the practice of insurance
agents using specialty designations or titles that imply to a
senior citizen that the agent has unique or special skills or
experience in matters relating to senior citizens' insurance
needs.
FISCAL EFFECT : This bill was referred to the Senate Floor from
the Senate Appropriations Committee pursuant to Senate Rule
28.8.
