          CONCURRENCE IN SENATE AMENDMENTS
AB 2768 (Utilities and Commerce Committee)

           Original Committee Reference: U. & C.

SUMMARY : Makes a number of minor technical changes that do not
substantially affect state law and deletes obsolete reporting
          requirements.

The Senate amendments delete obsolete reporting requirements.

AS PASSED BY THE ASSEMBLY , this bill was substantially similar
to the version passed by the Senate.

FISCAL EFFECT : Minor absorbable one-time costs for the courts
to re-program court case processing systems in order to
implement the California Department of Motor Vehicles reporting
          requirement.

COMMENTS : This bill is intended to make minor technical changes
to update the Public Resources Code to reflect the population
being appointed to or being elected to positions. For example,
the last two chairmen of the California Energy Commission have
not been men and the chairmen have noted that there have been
times when it is awkward being addressed as chairman.

This bill also makes a minor change to the Vehicle Code that
references a section of the Public Utilities Code. Last year,
AB 134 (Blakeslee) Chapter 414, Statutes of 2009, and AB 636
(Jones), Chapter 248, Statutes of 2009, both addressed the same
code section. AB 636 was amended near the end of session and
the members requested that AB 134 be signed first, and AB 636
signed second because it included the most current language.
The bills were signed in reverse order. As such, this bill
          corrects the signing order problem.

All of the provisions in this bill are non-substantive and
without opposition. In addition, the relevant regulatory
agencies have been consulted and have expressed no concerns.

As the code cleanup bill, the bill does not and will not contain
