BILL ANALYSIS AB 2771 Page 1 Date of Hearing: May 5, 2010 ASSEMBLY COMMITTEE ON LABOR AND EMPLOYMENT Sandre Swanson, Chair AB 2771 (Committee on Labor and Employment) - As Amended: April 8, 2010 SUBJECT : Wage statement: violations. SUMMARY : Deletes the reference of a repealed statute in Labor Code section 226.6. EXISTING LAW 1)Requires an employer to furnish employees with itemized wage statements containing specified information and to maintain and permit inspection of records pertaining to the statements. An employer who fails to do so is guilty of a crime. 2)Provides for misdemeanor liability and a fine and/or imprisonment for the knowing and intentional violation of Labor Code sections 226 or 226.2. FISCAL EFFECT : Unknown COMMENTS : This bill is a code clean up bill sponsored by the Conference of California Bar Associations that amends Labor Code section 226.6 to delete reference to a repealed statute, Labor Code section 226.2. The sponsor of the bill states that the Legislature repealed Labor Code section 226.2 in 1987, but neglected to remove the reference to the repealed statute in Labor Code section 226.6. This continued reference to a repealed statute in Labor Code section 226.6 is obsolete and confusing, and should be corrected by removal of the reference. This bill will accomplish this needed cleanup. A prior bill, AB 3060 (Committee on Labor and Employment), Chapter 55, Statutes of 2008 remedied a similar outdated reference to Labor Code section 226.2.
