BILL ANALYSIS AB 2780 Page 1 Date of Hearing: April 21, 2010 ASSEMBLY COMMITTEE ON INSURANCE Jose Solorio, Chair AB 2780 (Committee on Insurance) - As Introduced: March 3, 2010 SUBJECT : Insurers: reporting requirements SUMMARY : Eliminates several insurer annual reporting requirements, but authorizes the Insurance Commissioner (IC) to request the information at his or her discretion. Specifically, this bill : 1)Provides that a report by insurers that write liability insurance for long-term care facilities or other residential care facilities for the elderly shall be filed by a date specified by the IC not more than once in a calendar year. 2)Requires automobile insurers to report specified data relating to inspections of vehicles for which a property damage claim was paid at the request of the IC, but not more than annually. 3)Repeals a requirement that the IC report annually to the Governor and Legislature an analysis relating to the relationship between uninsured motorists and the affordability of automobile insurance. EXISTING LAW : 1)Provides that a report by insurers that write liability insurance for long-term care facilities or other residential care facilities for the elderly shall be filed by a date specified by the IC but no later than July 1 of each calendar year. 2)Requires automobile insurers to annually report to the IC specified data relating to inspections of vehicles for which a property damage claim was paid. 3)Requires the IC to report annually to the Governor and Legislature on a number of issues, including an analysis relating to the relationship between uninsured motorists and the affordability of automobile insurance. COMMENTS : The purpose of this committee bill is to reduce or eliminate the burden of obsolete or unnecessary data reporting requirements in the Insurance Code. The provisions currently in the bill have been vetted among the interested parties to ensure that appropriate data is available, if needed, but excessive collection of unused data is avoided.
