ANALYSIS : Existing law creates California Emergency Management Agency (CalEMA) and requires it to perform a variety of duties with respect to specified emergency preparedness, mitigation, and response activities in the state. CONTINUED AB 2791 Page 2 Prior to the creation of the CalEMA, these activities were the responsibility of the Governor's Office of Emergency Services (OES) and the Office of Homeland Security (OHS). The Budget Act of 2003 eliminated the Office of Criminal Justice Planning (OCJP) and its responsibilities for administering a variety of planning, training, education, and crime suppression and mitigation programs ultimately were assigned to OES. Comments When OES and OHS were merged to become CalEMA in January 2009, various codes sections were not updated to reflect this change in responsibility. Additionally, when the former OCJP was abolished, its responsibilities were redirected to OES, now CalEMA. Existing law does not clearly place these programs and functions within CalEMA. This bill also eliminates the statute for 13 different reports that CalEMA is required to produce and instead requires the information to be included in CalEMA's annual report.
