Code, relating to records.



	LEGISLATIVE COUNSEL'S DIGEST


   SB 359, Romero. Records: disclosure exemptions.
   Existing law, the California Public Records Act, requires each
state and local agency, as defined, to make its records open to
public inspection at all times during office hours, except as
specifically exempted from disclosure by law. The act specifically
exempts from disclosure records that are exempted or prohibited from
disclosure by federal or state law and lists records subject to that
exemption, specifying that the listed exemptions are not inclusive of
all exemptions under the act.
   This bill would revise the list of exempted records to reflect
changes in existing law.
   This bill would incorporate additional changes to Section 6276.24
of the Government Code, proposed by AB 1540, to be operative only if
AB 1540 and this bill are enacted, both bills amend Section 6276.24
of the Government Code, and this bill is enacted after AB 1540.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 6275 of the Government Code is amended to read:

   6275.  It is the intent of the Legislature to assist members of
the public and state and local agencies in identifying exemptions to
the California Public Records Act. It is the intent of the
Legislature that, after January 1, 1999, each addition or amendment
to a statute that exempts any information contained in a public
record from disclosure pursuant to subdivision (k) of Section 6254
shall be listed and described in this article pursuant to a bill
authorized by a standing committee of the Legislature to be
introduced during the first year of each session of the Legislature.
The statutes listed in this article may operate to exempt certain
records, or portions thereof, from disclosure. The statutes listed
and described may not be inclusive of all exemptions. The listing of
a statute in this article does not itself create an exemption.
Requesters of public records and public agencies are cautioned to
review the applicable statute to determine the extent to which the
statute, in light of the circumstances surrounding the request,
exempts public records from disclosure.

  SEC. 25.  Section 12.5 of this bill incorporates amendments to
Section 6276.24 of the Government Code proposed by both this bill and
AB 1540. It shall only become operative if (1) both bills are
enacted and become effective on or before January 1, 2010, (2) each
bill amends Section 6276.24 of the Government Code, and (3) this bill
is enacted after AB 1540, in which case Section 12 of this bill
shall not become operative.
