DIGEST : This bill corrects technical errors and
oversights, and makes numerous non-controversial and
conforming changes to various provisions of the Education
Code. Specifically, this bill (1) authorizes a parent or
guardian to release individual pupil test results of the
STAR program to a postsecondary educational institution for
the purpose of determining readiness for college-level
coursework; (2) clarifies that participants who fail to
complete the requirements for various loan assumption
programs "retain" rather than "resume" or "assume"
responsibility for any remaining loan obligations; and (3)
inserts a cross reference to existing law, which
establishes the percent hours per week considered a
full-time assignment for all community college faculty,
within community college clinical nursing faculty

provisions.
ANALYSIS : This bill is one of the annual Education Code
clean up bills that makes various non-controversial
revisions to statute. This education omnibus bill corrects
errors, resolves conflicts, and deletes obsolete references
that relate to postsecondary education. By tradition,
objection to any provision by the Department of Finance, or
any of the four legislative caucuses prevents that
provision from being included in this bill.
The bill makes three changes which are explained as
follows:
1. Section 1 . Provisions of SB 946 (Scott), Chapter 473,
Statutes of 2008), affecting Section 60641 of the
Education Code were chaptered out by AB 519 (Assembly
Budget Committee), Chapter 757, Statutes of 2008, which
was the education trailer bill for the 2008-09 Budget.
The changes authorized by the Legislature in SB 946 did
not take effect because AB 519 amended the same
education code section and was chaptered after SB 946.
2. Sections, 2, 3, 4, 5, 6, and 7 . Amendments to Sections
69613, 69613.6, 69667, 70101, 70104, and 70124 of the
Education Code clarifies that participants who fail to
complete the requirements for various loan assumption
programs "retain" rather than "resume" or "assume"
responsibility for any remaining loan obligations.
Although the assumption loan programs provide assistance
in the payment of loan obligations in exchange for
required service, the participants continue to be
responsible for any remaining loan obligations. These
amendments make that clarification.
3. Section 8 . Section 87482.5 was amended by AB 591
(Dymally), Chapter 84, Statutes of 2008, to increase
from 60 percent to 67 percent the proportion of hours
per week of a full-time faculty assignment which an
individual employed to teach adult or community college
courses may teach and still be classified as a temporary
employee. Section 87482 of the Education Code is
amended to cross reference Section 87482.5 in order to
conform clinical nursing faculty provisions to current
