SUBJECT : Postsecondary education.
SUMMARY : Makes conforming and technical changes to several
provisions of the Education Code. Specifically, this bill :
1)Authorizes a parent or guardian to release individual pupil
test results of the Standardized Testing and Reporting program
to a postsecondary educational institution for the purpose of
determining readiness for college-level coursework.
2)Clarifies that participants who fail to complete the
requirements for various loan assumption programs "retain"
rather than "resume" or "assume" responsibility for any
remaining loan obligations.
3)Inserts a cross reference to existing law that governs
community college clinical nursing faculty hours, which
establishes the percent of hours per week considered a
full-time assignment for all community college faculty.
FISCAL EFFECT : Unknown
COMMENTS : Background : This is one of several Education Code
"clean-up" bills that are introduced every year to make
non-controversial revisions. This education omnibus bill
corrects errors, resolves conflicts, and deletes obsolete
references that relate to postsecondary education. By
tradition, the clean-up bills do not include provisions that are
opposed by the Department of Finance or any of the four
legislative caucuses.
Technical changes : This bill makes three changes, as follows:
1)Section 1: AB 519 (Committee on Budget), Chapter 757,
Statutes of 2008, which was the 2008-09 Budget education
trailer bill, chaptered out provisions of SB 946 (Scott),
Chapter 473, Statutes of 2008, which established the

California Community Colleges Early Assessment Pilot Program.
Thus, the changes authorized by the Legislature in SB 946 did
not take effect because AB 519 amended the same Education Code
section and was chaptered after SB 946. This bill corrects
this chaptering-out problem.
2)Sections, 2, 3, 4, 5, 6, and 7: Amendments to Sections 69613,
69613.6, 69667, 70101, 70104, and 70124 of the Education Code
clarify that participants who fail to complete the
requirements for various loan assumption programs "retain"
rather than "resume" or "assume" responsibility for any
remaining loan obligations. Although the assumption loan
programs provide assistance in the payment of loan obligations
in exchange for required service, this bill clarifies that the
participants continue to be responsible for any remaining loan
obligations.
3)Section 8: Section 87482.5 was amended by AB 591 (Dymally),
Chapter 84, Statutes of 2008, to increase from 60% to 67% the
proportion of hours per week of a full-time faculty assignment
that an individual employed to teach adult or community
college courses may teach and still be classified as a
temporary employee. Section 87482 of the Education Code is
amended to cross reference Section 87482.5 in order to conform
clinical nursing faculty provisions to current law.
Related legislation : AB 1215 (De La Torre), which was approved
by this Committee in May and is pending in the Senate, is
identical to the section of this bill that cross-references
part-time faculty assignments to conform clinical nursing
faculty to current law. The Senate Education Committee has
introduced two additional technical clean-up bills-SB 509 and SB
512, which are both pending in the Assembly Education
Committee-that amend statutes related to K-12.
