BILL ANALYSIS SB 583 Page 1 Date of Hearing: July 1, 2009 ASSEMBLY COMMITTEE ON APPROPRIATIONS Kevin De Leon, Chair SB 583 (Hollingsworth) - As Amended: May 5, 2009 Policy Committee: Public Safety Vote: 7-0 Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill requires the Department of Justice (DOJ) to record the type of residence at which sex offenders reside and provide the information to the Department of Social Services or other state agencies for law enforcement purposes related to investigative responsibilities regarding sex offenders. Specifically, this bill: 1)Requires the residence identifier to consist of a description of the nature of the dwelling, specifically whether it is a single-family residence, apartment/condominium, motel/hotel, or a licensed facility. 2)Requires each address to be stored by DOJ in the same database as the registration data recorded pursuant to Penal Code Section 290.015. 3)Specifies this section becomes operative January 1, 2012. FISCAL EFFECT Minor absorbable costs to DOJ. Delaying the operational date of this measure to January 2012, allows DOJ to incorporate this provision into its new database system scheduled for implementation in 2010. COMMENTS 1)Rationale. The intent of this bill is to ensure sex offenders are not residing in licensed facilities that may also serve children by requiring DOJ to assign and maintain a unique SB 583 Page 2 identifier to each registered sex offender address, indicating the type of residence, and by requiring DOJ to authorize disclosure between agencies on an as-needed law enforcement basis. 2)Current law requires specified sex offenders to register with local law enforcement. Sex offender registration consists of: a) a written statement providing information required by DOJ and providing the name and address of employment and employer; b) fingerprints and a current photograph taken by the registering official; c) the license plate number of any vehicle owned or driven by the registrant; d) notice that the registrant may have to register in another state upon relocation; and, e) proof of residence.
