BILL ANALYSIS SB 781 Page 1 Date of Hearing: August 19, 2009 ASSEMBLY COMMITTEE ON APPROPRIATIONS Kevin De Leon, Chair SB 781 (Leno) - As Amended: June 8, 2009 Policy Committee: Human ServicesVote: 6 - 0 Judiciary 10 - 0 Urgency: No State Mandated Local Program: Yes Reimbursable: No SUMMARY This bill requires a Residential Care Facility for the Elderly (RCFE) to include additional information when providing a notice of eviction to a resident, including the reason for the eviction, the effective date of the eviction, and additional information informing the resident of his or her rights regarding evictions. FISCAL EFFECT There are no significant costs associated with this legislation. COMMENTS 1)Purpose . This bill seeks to raise consumer awareness. According to the author, elderly seniors living in RCFEs should not be expected to know all of the legal protections designed to shield them from unfair evictions. SB 781 requires RCFEs to include additional information to residents that will help reduce unfair evictions and minimize the risk of displacement and transfer trauma. 2)Background . RCFEs serve persons 60 and older. They provide room, board, housekeeping, supervision, and assistance with basic activities like personal hygiene, dressing, eating, and walking. These facilities often store their residents' medication in a central location and assist the residents with self-administering their medication. SB 781 Page 2 These facilities are designed for people who are unable to live by themselves but who do not need 24 hour nursing care. They are considered non-medical facilities and are not required to have nurses, certified nursing assistants or doctors on staff. The Department of Social Services Community Care Licensing Division is responsible for licensing and monitoring all RCFEs in the state.
