ANALYSIS : The State Department of Water Resources (DWR) regularly revises the California Water Plan. DWR's Bulletin 160-09 is the "California Water Plan Update 2009." DWR must also prepare the Central Valley Flood Protection Plan. Within two years of the Plan's adoption by the Central Valley Flood Protection Board, cities and counties in the Sacramento-San Joaquin Valley must amend their general plans to protect lives and property. The statutory definition of the Sacramento-San Joaquin Valley specifically excludes the Tulare Lake basin, including the Kings River (SB 5, Machado, Chapter 362, Statutes of 2007). This bill defines the "Tulare Lake Basin" as the Tulare CONTINUED SB 1070 Page 2 Lake Hydrologic Region as defined by the California Water Plan Update 2009. Comments To clarify what land is outside the Sacramento-San Joaquin Valley planning area for flood protection, this bill creates a specific definition that relies on the California Water Plan's designation of the Tulare Lake Basin.
