An act relating to education finance, and making an appropriation
therefor, to take effect immediately as an appropriation for the
usual and current expenses of the state.

AB 1, as introduced, John A. Pérez. Education finance: CalWORKs
Stage 3.
Existing law requires that child care be provided in 3 stages to
recipients of benefits under the California Work Opportunity and
Responsibility to Kids (CalWORKs) program. The first stage of child
care begins upon the entry of a person into the CalWORKs program. The
2nd stage of child care begins when a county determines that the
work or approved work activity of the recipient is stable or when a
recipient is making the transition off of aid and child care is
available through a local stage 2 program. The 3rd stage of child
care, which is administered by programs contracting with the State
Department of Education, begins when a funded child care space
becomes available for the child or children of the eligible CalWORKs
recipient.
This bill would reappropriate $118,000,000 in unobligated balances
appropriated in the Budget Act of 2009, and from the federal Child
Care and Development Block Grant, and would also appropriate
$115,534,000 from the General Fund, to the State Department of
Education for CalWORKs Stage 3 child care services. The bill would
also require the State Department of Education to use those funds for
families that were receiving, or would have been eligible to
receive, CalWORKs Stage 3 child care development services, on or
after October 31, 2010.
The bill would declare that it makes appropriations for the usual
and current expenses of the state, thereby taking immediate effect.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. It is the intent of the Legislature to restore funding
to CalWORKs Stage 3 child care and development services, retroactive
to November 1, 2010.
SEC. 2. (a) Notwithstanding any other provision of law, the
unobligated balances from the following budget items are
reappropriated to the State Department of Education for CalWORKs
Stage 3 child care services, in augmentation of, and for the purposes
specified in, Schedule (1.5)(f) of Item 6110-196-0001 of Section
2.00 of the Budget Act of 2010 (Ch. 712, Stats. 2010).
(1) Fifteen million three hundred thousand dollars ($15,300,000)
of the liquidated federal fund balance appropriated in Item
6110-196-0890, as included in Schedule (1.5) of Item 6110-196-0001 of
Section 2.00 of the Budget Act of 2009 (Ch. 1, Stats. 2009).
(2) Forty-two million seven hundred thousand dollars ($42,700,000)
from the federal Child Care and Development Block Grant funds
appropriated prior to the 2010 fiscal year.
(3) Twenty million dollars ($20,000,000) from Schedule (1) of Item
6110-196-0001 of Section 2.00 of the Budget Act of 2009 (Ch. 1,
Stats. 2009).
(4) Forty million dollars ($40,000,000) from Schedule (1.5) of
Item 6110-196-0001 of Section 2.00 of the Budget Act of 2009 (Ch. 1,
Stats. 2009).
(b) The sum of one hundred fifteen million five hundred
thirty-four thousand dollars ($115,534,000) is hereby appropriated
from the General Fund for transfer by the Controller to Section A of
the State School Fund for CalWORKs Stage 3 child care services, in
augmentation of, and for the purposes specified in, Schedule (1.5)(f)
of Item 6110-196-0001 of Section 2.00 of the Budget Act of 2010 (Ch.
712, Stats. 2010).
(c) Pursuant to this section, the State Department of Education
shall use the funds appropriated in subdivisions (a) and (b) for
families who were eligible for and receiving CalWORKs Stage 3 child
care services pursuant to Section 8354 of the Education Code on or
before October 31, 2010, and for those families who would have
otherwise been eligible to receive CalWORKs Stage 3 child care
services after October 31, 2010.
SEC. 3. This act makes an appropriation for the usual current
expenses of the state within the meaning of Article IV of the
Constitution and shall go into immediate effect.
