BILL ANALYSIS Ó AB 806 Page 1 Date of Hearing: April 26, 2011 ASSEMBLY COMMITTEE ON JUDICIARY Mike Feuer, Chair AB 806 (Torres) - As Introduced: February 17, 2011 PROPOSED CONSENT SUBJECT : Common Interest Developments: Statutory Reorganization KEY ISSUE : Should technical and conforming changes be made to other code sections, so that all cross-references are consistent with the proposed reorganization of the Davis-Stirling Act AS proposed by Assembly bill 805? FISCAL EFFECT : As currently in print this bill is keyed non-fiscal. SYNOPSIS This bill makes technical and conforming changes to other code sections so that all cross-references to the Davis-Stirling Common Interest Development Act are consistent with the comprehensive reorganization and recodification of that Act, as proposed by AB 805. This bill is therefore contingent upon enactment of AB 805. Both AB 805 and AB 806 passed unanimously out of the Assembly Housing and Community Development Committee. There is no known opposition to either bill. SUMMARY : Makes, as of January 1, 2014, technical and conforming changes to reflect a proposed reorganization and recodification of the Davis-Stirling Common Interest Redevelopment Act. The operation of this bill, therefore, is contingent upon the enactment and operation of that revision and codification as provided in AB 805 of this session. EXISTING LAW establishes the rules and regulations governing the operation of a CID and the respective rights and duties of an HOA and its members. (Civil Code Sections 1350-1378.) COMMENTS : This is bill is a companion measure to AB 805 (Torres), which reorganizes and recodifies the Davis-Stirling Common Interest Development Act as recommended by the California Law Revision Commission (CLRC). This bill will ensure that other code provisions that cross-reference the Davis-Stirling Act will correspond to the new section numbers created by AB 805. ARGUMENTS IN SUPPORT : According to the author and the CLRC, this bill and its companion measure, AB 805, will bring much needed logical order to the Davis-Stirling Act, making it much easier for board members and practitioners to navigate and clarifying the relative authority of statutory law, by-laws, and different types of governing documents.
