   An act to  amend Section 2933 of   add
Section 2933.5 to  the Vehicle Code, relating to vehicles.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1047, as amended, Jeffries. Vehicles: motorcycle safety.
   Existing law establishes the motorcyclist safety program in the
California Department of Highway Patrol, to be administered by the
commissioner.  Existing law specifies that the commissioner
is prohibited from directly managing or providing program services.
Existing law requires program services financed under the law to be
provided under contractual arrangements or grant funding. 
 Existing law authorizes the commissioner, through contracts with
other public agencies or with private entities, to fund projects to
enhance motorcycle operation or safety such as rider training
programs, to sponsor and coordinate efforts to increase motorists'
awareness of motorcyclists, to sponsor research on communicating
motorcyclist safety to highway users, and to adopt standards relating
to a novice motorcyclist   training program. 
   This bill would  make a technical, nonsubstantive change
to that law   expressly prohibit a local law enforcement
agency receiving grant money for a motorcyclist safety program from
using that money for the implementation of motorcycle only
checkpoints  .
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 2933.5 is added to the 
 Vehicle Code   , to read:  
   2933.5.  A local law enforcement agency receiving grant money for
a motorcycle safety program pursuant to this article shall not use
the money for the implementation of motorcycle only checkpoints.
 
  SECTION 1.    Section 2933 of the Vehicle Code is
amended to read:
   2933.  The commissioner shall not directly manage or provide
program services. A program service financed under this article shall
be provided under contractual arrangements or grant funding. All
public agencies assisting or providing program services under this
article shall be fully reimbursed for their costs by the
commissioner. The commissioner shall monitor and evaluate any
contracts or grants executed pursuant to this article to ensure that
the provisions of the contracts or grants are adhered to by the
recipients.
