SUMMARY : Prohibits the sale of a commodity when it is sold based upon a quantity represented by the purchaser or using the purchaser's equipment from paying the seller less than the highest applicable per unit for that commodity. The Senate amendments clarify the prohibition of a purchaser from computing the purchase price of the commodity according to a price per unit of measure that is less than the highest applicable price per unit that is represented by the purchaser to the seller for that commodity, or is less than a price per unit established in law. EXISTING LAW : 1)Makes it a crime for a person, firm, corporation, or association to advertise, solicit, or represent by any means a product for sale or purchase if it is intended to entice a consumer into a transaction different from that originally represented. 2)Provides that when the sale of any commodity is based upon a quantity representation either furnished by the purchaser or obtained through the use of equipment supplied by the purchaser, the purchaser is prohibited from buying the commodity according to any quantity which is less than the true quantity. AS PASSED BY THE ASSEMBLY , this bill was substantially similar to the version approved by the Senate.
