Amended: 8/23/12 in Senate Vote: 21 PRIOR VOTES NOT RELEVANT SUBJECT : Vehicles: recreational off-highway vehicles SOURCE : Author DIGEST : This bill delays the implementation, from January 1, 2013 until July 1, 2013, of the provision of AB 1595 (Cook, Chapter 165, Statutes of 2012), which defined recreational off-highway vehicles (ROHVs) and prescribed safety regulations for their use in California. ANALYSIS : Existing law, commencing January 1, 2013, establishes rules for the operation of, and requirements for equipment of, an off-highway vehicle, including prohibiting a person who is operating an ROHV from allowing a passenger to occupy a separate seat location not designed and provided by the manufacturer for a passenger. Existing law, commencing January 1, 2013, prohibits a person operating an ROHV from riding with a passenger, unless the passenger, among other things, have both feet flat on the floorboard. This bill: CONTINUED AB 1266 Page 2 1. Delays AB 1595's requirement that all passengers must occupy seats provided by the vehicle manufacturer from January 1, 2013, until July 1, 2013 in order to give ROHV owners additional time to comply with this new requirement and for additional legislation to define what sort of after-market seats could be added to an ROHV. 2. Deletes AB 1595's requirement that an ROHV passenger must be able to put both feet flat on the floorboard when grasping the handhold with the safety harnessed fastened and seated upright. This change is in order to continue to allow children to ride as passengers in ROHVs.
