BILL ANALYSIS Ó AB 1313 Page 1 Date of Hearing: May 4, 2011 ASSEMBLY COMMITTEE ON LABOR AND EMPLOYMENT Sandre Swanson, Chair AB 1313 (Lara) - As Amended: March 31, 2011 SUBJECT : Employment: agricultural workers. SUMMARY : Requires the Agricultural Labor Relations Board (ALRB) and its general counsel to post on their web site specified information about open cases. Specifically, this bill : 1)Specifies that the ALRB and its general counsel shall publish on the ALRB's internet web site the following information regarding each open case, including unfair labor practices charges: a) The name of the case; b) The nature of the case; c) The date the case was opened; d) The status of the case; e) The expected developments in the case, and; f) The anticipated timeline for resolution of the case. EXISTING LAW : 1)Requires the ALRB to make a report to the Legislature and the Governor at the close of each fiscal year, stating in detail the cases it has heard, the decisions it has rendered and specified information about all employees and officers employed or under the supervision of the ALRB, including an account of all monies it has disbursed. 2)States that the general counsel of the ALRB, who is appointed by the Governor and subject to confirmation by a majority of the Senate, as specified, shall have final authority on behalf of the ALRB with respect to the investigation of charges and issuance of complaints under unfair labor practices, as specified, and prosecution of such complaints. FISCAL EFFECT : Unknown COMMENTS : According to the author's statement, "the California Agricultural Labor Relations Board was created in 1975 to ensure AB 1313 Page 2 stability in agricultural labor relations and justice for agricultural workers. Labor Code Section 1143 requires the ALRB to annually report to the Legislature and the Governor on the cases heard, decisions rendered, the names salaries, and duties of all employees and officers under the supervision of the ALRB, and an account of moneys it has disbursed. The Board's annual report is published online at www.alrb.ca.gov . Currently, the ALRB does not include certain information regarding each open case on its web site. This bill would require the ALRB and its general counsel to publish on the ALRB's web site certain information regarding each open case, including unfair labor practice charges."
