To the Members of the California State Assembly:

I am returning Assembly Bill 1389 without my signature.

This measure would impose greater restrictions on local law
enforcement when operating sobriety checkpoints than what is
currently required by the California Supreme Court.

For example, this measure would state a preference for checkpoints to
operate after dusk even though fatal driving injuries involving drug
use occur between 2:00PM and 7:00PM.  This measure would also
require law enforcement to announce the specific location of a
checkpoint, 48 hours in advance, allowing drunk drivers to avoid
detection altogether.

While I understand there are concerns that some sobriety checkpoints
are being operated improperly, this bill is far too restrictive on
local law enforcement.
