Senate Floor Amendments of 8/31/11 add co-authors and make a technical change. ANALYSIS : Existing law creates in the State Treasury the CONTINUED AB 1417 Page 2 Indian Gaming Special Distribution fund for the receipt and deposit of monies received by the state from certain Indian tribes pursuant to the terms of gaming compacts entered into with the state. Existing law authorizes monies in that fund to be used for specified purposes, including for grants for the support of state and local government agencies impacted by tribal government gaming. This bill appropriates $9.1 million from the Indian Gaming Special Distribution Fund to the California Gambling Control Commission to provide grants to local agencies for the purpose of mitigating the adverse impacts of tribal gaming. Comments The $9.1 million appropriated in this bill, will be used to provide grants to local governments for the purpose of mitigating the adverse impacts of tribal gaming. Existing law creates the Indian Gaming Special Distribution Fund for the receipt of revenue contributions made by tribal governments pursuant to the terms of the 1999 model Tribal-State Gaming Compacts and authorizes the Legislature to appropriate money from the Gaming Special Distribution Fund for the following purposes: (a) grants for gambling addiction programs, ( b) grants for the support of state and local government agencies impacted by tribal gaming, (c) compensation for regulatory costs incurred by the California Gambling Control Commission and the Department of Justice in connection with implementation and administration of compacts, (d) payment of shortfalls that may occur in the Indian Gaming Revenue Sharing Trust Fund, (e) disbursements for the purpose of implementing the terms of tribal labor relations ordinances promulgated in accordance with the terms of the 1999 compacts, and (f) any other purpose specified by law. Prior Legislation SB 827 (Senate Governmental Organization), 2009-10 Session, would have established a stand-alone article within the Government Code for compacts. Although grants offered through the SDF program do not address all the affects of Indian gaming, the funding is critical to local communities. Communities experience a myriad of costly impacts to infrastructure and services, including, but not limited to, roads, behavioral health and public safety. While these special funds will have no impact on the State's General Fund or budget, they will enable local governments to use this dedicated revenue for its intended purpose. During these challenging economic times, these funds are more vital than ever.
