SUMMARY : Prohibits junk dealers and recyclers from purchasing or receiving bulk merchandise pallets marked with an indicia of ownership from anyone except the indicated owner unless specified information is provided, and allows junk dealers or recyclers to accept a passport or a Matricula Consular, in combination with the address from an additional form of identification, or a United States-issued identification card number as one of the methods of identification required for recordkeeping purposes and for payment of nonferrous materials. The Senate amendments : 1)Allow junk dealers or recyclers to accept a passport or a Matricula Consular, in combination with the address from an additional form of identification, or a United States-issued identification card number as one of the methods of identification required for recordkeeping purposes and for payment of nonferrous materials. 2)Add language to avoid chaptering out issues with AB 1508 (Carter). EXISTING LAW : 1)Authorizes junk dealers and recyclers to sell and purchase junk, as defined, requires junk dealers and recyclers to maintain written records of specified information, and prohibits payment for nonferrous materials unless certain conditions are met. 2)Prohibits and makes it a crime for an unauthorized person, as defined, to possess a merchandise pallet or for a person other than its owner to obliterate the identification notice on a pallet. AB 1583 Page 2 3)Requires any person or entity purchasing plastic bulk merchandise containers who is in the business of recycling, shredding, or destruction of plastic bulk merchandise containers, as defined, to obtain a proof of ownership record and other identifying information from a person selling five or more containers, and to retain the required record for a specified time. AS PASSED BY THE ASSEMBLY , this bill prohibited junk dealers and recyclers from purchasing or receiving bulk merchandise pallets marked with an indicia of ownership from anyone except the indicated owner, unless specified information is provided. FISCAL EFFECT : According to the Senate Appropriations Committee, pursuant to Senate Rule 28.8, negligible state costs.
