                                     SUBJECT  
             State Contracts: reports: lesbian, gay, bisexual, and 
                             transgender businesses

                                   DESCRIPTION
           
          AB 1960 expands an existing reporting requirement imposed 
          on the Department of General Services (DGS) relative to the 
          level of participation of business enterprises in state 
          contracts by race, ethnicity, and gender to also include, 
          commencing January 1, 2013, lesbian, gay, bisexual, or 
          transgender-owned (LBGT-owned) businesses.

                                   EXISTING LAW

           Existing law requires DGS to make available a report on 
          contracting activity containing specified information, 
          including the level of participation of business 
          enterprises, by race, ethnicity, and gender of owner for 
          the following categories of contracts, to the extent that 
          the information has been voluntarily reported to DGS: (a) 
          construction; (b) purchases of materials, supplies or 
          equipment; and, (3) professional services.

                                    BACKGROUND
          
           Purpose of AB 1960:   The author's office points out that 
          currently, the level of participation of business 
          enterprises by race, gender, and ethnicity of contractor is 
          collected by DGS and reported annually.  The author's

          office notes that AB 1960 represents a small, but vital 
          step toward breaking down discriminatory barriers 
          marginalizing a key segment of our population by simply 
          adding this integral part of the California economy and 
          community to the existing reporting requirements. The 
          author's office believes that such information has the 
          ability to show the extent to which this essential segment 
          of the society drives the state economy.
