Perez) - As Amended: April 26, 2012 Policy Committee: Education Vote:10-1 Urgency: No State Mandated Local Program: No Reimbursable: No SUMMARY This bill requires the Instructional Quality Commission (IQC) and the State Board of Education (SBE) to ensure that the health and science curriculum frameworks adopted in the course of the next submission cycle following the date this measure becomes effective to include the subject of organ procurement and tissue donation, as appropriate. FISCAL EFFECT Potential GF administrative costs, likely between $175,000 and $250,000, to the State Department of Education's (SDE) IQC to complete the requirements of this measure. This assumes a portion of the IQC's funding is restored to complete the development of the health curriculum framework, as specified. Governor Schwarzenegger vetoed all GF funding ($700,000) for the Curriculum Development and Supplemental Materials Commission (now the IQC) in 2009. To date, this funding has not been restored. COMMENTS 1)Background . The IQC, formerly the Curriculum Development and Supplemental Materials Commission, is an 18-member advisory board to SBE. Thirteeen members are appointed by the SBE. The remaining members are one member each of the Assembly and Senate, one public member appointed by the Speaker of the Assembly, one by the Senate Rules Committee, and one by the governor. Commissioners tend to be recognized authorities in a specific subject matter, professors, curriculum experts, K-12 teachers, or community members. AB 1967 Page 2 The IQC advises SBE on the K-12 curriculum frameworks and K-8 instructional materials (IM). In doing so, it serves as an intermediary between the field experts and SBE. The commission holds a public hearing on a framework after the Subject Matter Committee hearing and before the SBE hearing on the framework. It also holds a public hearing on IM after content panel members develop their evaluation report and before SBE holds a hearing to adopt the materials. 2)Purpose . SB 112 (Spier), Chapter 405, Statutes of 2003, established a centralized organ and tissue donation registry for California. As a result of this legislation, the Donate Life California Organ and Tissue Donor Registry (Donate Life California), a private, nonprofit, state-authorized registry, was established with the goal of providing every person awaiting a transplant access to information that can provide a match. According to Donate Life America, there are currently more than 113,000 people on the UNOS National Organ Transplant Waiting List. Of these individuals, approximately 21,000 (19%) live in California. As of May 2012, there are currently 9 million people registered with Donate Life California. This bill requires the IQC and the SBE to ensure that the health and science curriculum frameworks adopted in the course of the next submission cycle include the subject of organ procurement and tissue donation, as appropriate. 3)Limited duties of IQC until 2014-15 . AB 2 X4 (Evans), Chapter 2, Statutes of 2009, specified that local education agencies (LEAs) are not required to purchase IM through the 2012-13 FY. Consistent with the non-purchasing requirement, Chapter 2 also suspended the requirement for SBE to adopt IM or conduct other procedures associated with adoption (i.e., adopting curriculum frameworks) until the 2013-14 school year. SB 70 (Committee on Budget and Fiscal Review), Chapter 7, Statutes of 2011, extended this suspension until the 2014-15 FY. As a result, there is not any need for the IQC to conduct work related to the adoption of IM. AB 250 (Brownley), Chapter 608, Statues of 2011, renamed the Curriculum Development and Supplemental Materials Commission the IQC and lifted the moratorium on the development of AB 1967 Page 3 curriculum frameworks only for the purposes of developing frameworks for the Common Core Standards in English language arts and mathematics. In light of this exemption, the SBE decided to appoint members to complete this work. Prior to 2012, the SBE had not appointed IQC members to fill vacancies due to the IM moratorium referenced above. 4)Previous related legislation . AB 1118 (J. Perez) contained the same provision relating to the Health Curriculum Framework as proposed in this measure and required a school district, commencing with the 2012-13 school year, to provide pupils who are enrolled in health classes in grades 9 and 10 at least 15 minutes of instruction in organ procurement and tissue donation, as specified.
