           SUBJECT  :  California Interscholastic Federation report: 
          electronic submission.
          
           SUMMARY
           
          This bill requires the California Interscholastic Federation 
          (CIF), when it submits the report on its evaluation and 
          accountability activities to the Legislature and Governor, to 
          also provide an electronic copy of the report to specific 
          legislative policy committees.

           BACKGROUND
           
          Current law:

          1)   Establishes CIF as a voluntary organization responsible for 
               administering high school interscholastic athletics and 
               sunsets this authorization on January 1, 2017.  (Education 
               Code § 33353) 

          2)   Requires CIF to report to the Legislature and Governor by 
               January 1, 2016, on several specified goals and objectives, 
               such as effectiveness of the governance structure, gender 
               equity, health and safety, and economic viability.  (EC § 
               33353)   

          3)   Authorizes the California Department of Education to 
               determine if the policies of school districts and CIF are 
               in compliance with state and federal laws, as specified.  
               (EC § 33354)

           This bill  requires the California Interscholastic Federation, 
          when it submits the report on its evaluation and accountability 
          activities to the Legislature and Governor, to also provide an 
          electronic copy of the report to the Assembly Committee on Arts, 
          Entertainment, Sports, Tourism and Internet Media, the Assembly 
          Committee on Education, and the Senate Committee on Education.

           STAFF COMMENTS
           
           1)   Need for the bill  .  According to the author, "In 2008, the 
               Assembly Committee on Arts, Entertainment, Sports, Tourism 
               and Internet Media held an informational hearing looking 
               into the state oversight of the California Interscholastic 
               Federation (CIF), and the organization's operation of state 
               athletic competitions.  The Committee learned that the 
               assignment to the CIF of administering interscholastic 
               athletic activities in California secondary schools is 
               subject to a five year sunset.  Each five year renewal 
               period, according to the Education Code, is to be 
               accompanied by an Evaluation and Accountability Goals and 
               Activities Report to the Legislature and Governor.  This 
               sunset review and report, in large part, provide the only 
               meaningful oversight which the state exercises over the 
               CIF.  However, the distribution of the report makes such 
               oversight difficult, as the Education Code does not state 
               to whom the report must be given.  Current practice of the 
               CIF is to deliver copies to the Speaker of the Assembly and 
               President Pro Tempore of the Senate, along with the 
               Minority Leaders of each house.  Testimony in the 
               informational hearing determined that better legislative 
               oversight would be provided if the interested policy 
               committees were also given copies of the report.  One of 
               the recommendations coming out of the Committee's 
               informational hearing was to have the CIF distribute their 
               Evaluation and Accountability Goals and Activities Report 
               to the Assembly and Senate Education Committees, as well as 
               the Assembly Arts, Entertainment, Sports, Tourism and 
               Internet Media Committee. 

           2)   Legislative oversight  .  As indicated in the author's 
               statement, the legislature has historically extended the 
               sunset on the statutory provisions related to CIF for 
               periods of five years.  This allows the Legislature some 
               level of oversight of the CIF, the California Department of

               Education, participating school districts and athletic 
               leagues in dispensing with issues as they arise, such as 
               gender equity (Title IX) and testing athletes for 
               performance-enhancing drugs.  

           3)   Submission and availability of report  .  According to the 
               CIF, the most recent report (December 2009) was submitted 
               to both the Senate and Assembly Education Committees, 
               legislative leadership, the Governor and Superintendent of 
               Public Instruction.  The report is also currently posted on 
               the CIF Web site.

           4)   Prior legislation  .  SB 107 (Price, Ch. 230, 2011) extended 
               the sunset for the CIF from January 1, 2012, to January 1 
               2017, and extended existing reporting requirements.

          SB 562 (Torlakson, Ch. 301, 2006) among other things, extended 
               the sunset on CIF statutes from January 1, 2007, to January 
               1, 2012. 

          SB 225 (Kuehl, Ch. 889, 2001) among other things, extended the 
               sunset date from January 1, 2001, to January 1, 2007.
