   An act to amend Section 65563 of the Government Code, relating to
local planning.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2351, as introduced, Gordon. Local planning: open-space plan.
   (1) The Planning and Zoning Law requires every city and county to
prepare, adopt, and submit to the Secretary of the Natural Resources
Agency, on or before December 31, 1973, a local open-space plan for
the comprehensive and long-range preservation and conservation of
open-space land within its jurisdiction.
   This bill would delete the December 31, 1973, date from the
above-specified provisions, thereby imposing a state-mandated local
program.
   (2) The California Constitution requires the state to reimburse
local agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that no reimbursement is required by this
act for a specified reason.
   Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 65563 of the Government Code is amended to
read:
   65563.   On or before December 31, 1973, every 
 Every  city and county shall prepare, adopt  , 
and submit to the Secretary of the  Natural  Resources
Agency a local open-space plan for the comprehensive and long-range
preservation and conservation of open-space land within its
jurisdiction.  Every city and county shall by August 31,
1972, prepare, adopt and submit to the Secretary of the Resources
Agency, an interim open-space plan, which shall be in effect until
December 31, 1973, containing, but not limited to, the following:
 
   (a) The officially adopted goals and policies which will guide the
preparation and implementation of the open-space plan; and 

   (b) A program for orderly completion and adoption of the
open-space plan by December 31, 1973, including a description of the
methods by which open-space resources will be inventoried and
conservation measures determined. 
  SEC. 2.  No reimbursement is required by this act pursuant to
Section 6 of Article XIII B of the California Constitution because a
local agency or school district has the authority to levy service
charges, fees, or assessments sufficient to pay for the program or
level of service mandated by this act, within the meaning of Section
17556 of the Government Code.
