Specifically, this bill : 1)Authorizes the Ronald Reagan Centennial Capitol Foundation (Foundation), in consultation with the Department of General Services (DGS), to plan and construct a memorial to Ronald Reagan in the State Capitol Building Annex. 2)Establishes the Ronald Reagan Memorial Review Committee, which shall include the director of DGS, the State Historic Preservation Officer or their designee, a member of the Assembly appointed by the Assembly Speaker, and a member of the Senate appointed by the Senate Rules Committee. Requires the Ronald Reagan Memorial Review Committee to consult with the Foundation to identify an appropriate location and design for the memorial. 3)Requires DGS, in consultation with the Foundation, to review preliminary designs, ensure American with Disabilities Act (ADA) compliance, review and approve California Environmental Quality Act (CEQA) documents, review final construction documents, prepare the right-of-entry permit as specified, prepare a maintenance agreement, and inspect the construction performed by the contractor selected by the Foundation. AB 2358 Page 2 4)Requires the Foundation, if it elects to undertake responsibility for construction of the memorial, to, in consultation with DGS, establish a schedule, solicit designs, and establish a program for the dedication. 5)Requires the design and all other aspects of the memorial to be approved by DGS and the Ronald Reagan Memorial Review Committee, and requires the Foundation to receive the approval of the Ronald Reagan Memorial Review Committee before proceeding with installation of the memorial. 6)Provides that construction of the memorial shall not begin until the Department of Finance (DOF) has determined sufficient private funding is available to construct and maintain the memorial. 7)Requires that the planning, construction and maintenance of the memorial be funded exclusively through private donations to the Foundation. 8)Requires the Foundation, if it elects to undertake responsibility for construction of the memorial, to sign a maintenance agreement with the state to maintain the memorial with private contributions. EXISTING LAW : 1)Establishes the State Capitol Park as a unit of the state park system. The State Capitol Park is part of the Capitol Historic Region of the state park system, which also includes the State Capitol Museum and several other historic state park units. The State Capitol Park is a unit of the state park system but is managed by DGS. 2)Creates the DGS and gives DGS general authority for planning, acquisition and maintenance of state buildings and properties. FISCAL EFFECT : According to the Assembly Appropriations Committee, minor, absorbable costs to DGS and DOF to consult with the Foundation and review legal and financial requirements. COMMENTS : The author has introduced this bill to honor President Ronald Reagan. The author states that "President AB 2358 Page 3 Ronald Reagan is an American icon who spent the beginning of his political career making decisions in the California State Capitol. President Reagan remains one of the most influential leaders in both our state and country's history and deserves to be honored for his significant political presence in California's Capitol. In state capitols across the country, memorials stand in tribute to past presidents. President Jimmy Carter welcomes guests at Georgia's capitol; Lyndon B. Johnson stands tall at the Texas capitol in Austin; and John F. Kennedy is presented in front of Boston's state house. There have been forty-four United States presidents, and precisely one of them has lived in Sacramento and governed the state of California. The fortieth president of the United States deserves to be honored with a statue in the golden state's capitol. AB 2358 is an important step toward honoring the only governor of California to become president of the United States." A previous version of this bill would have provided for construction of the memorial in the Capitol Historic Region, which includes the State Capitol Park surrounding the State Capitol building in Sacramento. The park currently contains several memorials, including a Civil War Memorial Grove, a statue of Father Junipero Serra, a California Vietnam Veterans Memorial, and a California Veterans Memorial honoring California veterans from the Mexican-American War, the Civil War, the Spanish-American War, World War I, World War II, the Korean War, the Vietnam War, and the Persian Gulf War. As amended, this bill would provide for placement of the Ronald Reagan memorial inside the State Capitol Building Annex with the exact location to be determined. This bill is similar to other existing statutes giving authority for construction of other memorials in the State Capitol Park. Other authorized memorials include a Crime Victims Memorial, a Purple Heart Memorial, a California Search and Rescue Volunteers Memorial, and a Genocide Survivors Memorial. Each of these authorizing statutes, like this bill, makes construction of the memorial contingent on receipt of private funding.
