SUMMARY : Authorizes the governing board to eliminate the
requirement for the Los Angeles Community College District
(LACCD) to conduct a run-off election if no candidate for an
individual seat on the district's governing board receives more
than 50% of the total votes cast in the primary election,
commencing with the 2013 election.
The Senate amendments allow the LACCD governing board to adopt a
resolution authorizing the elimination of the requirement to
conduct a run-off election for a seat on the district's
governing board if no candidate for that seat received more than
50% of the total votes cast in the primary election.
EXISTING LAW requires members of the governing board of the
LACCD be elected at-large and establishes seat numbers for board
member elections. Members hold office for four years. Provides
that elections are held every two years, falling in the odd
numbered years beginning in 1969, and alternating between office
numbers one, three, five, and seven and office numbers two,
four, and six. Provides that primary elections are held the
first Tuesday in April of every odd-numbered year, and general
elections are held the last Tuesday in May of every odd-numbered
year.
AS PASSED BY THE ASSEMBLY , this bill eliminated the requirement
for the LACCD to conduct a run-off election if no candidate for
an individual seat on the district's governing board received
more than 50% of the total votes cast in the primary election.
FISCAL EFFECT : Unknown. This bill has been keyed non-fiscal by
the Legislative Counsel.
COMMENTS : According to the author, "Under current law, the Los

Angeles Community College District is required to have its
elections coincide with the city of Los Angeles. If a candidate
receives less than 50% of the vote in the initial election, then
the district must hold a run-off for the top two vote-getters.
The requirement for a primary and a run-off has created a
significant financial burden for the Los Angeles Community
College District. The process of holding an additional election
has reduced the district's resources that would otherwise go
toward meeting its core mission of serving students and the
community.
"Enactment of this bill would eliminate the requirement that the
Los Angeles Community College District conduct a run-off
election if no candidate receives more than 50% of the vote. The
change would save the district $3 million to $5 million every
two years. The savings could be redirected to the district's
core mission of serving students."
This bill, when passed by the Assembly, eliminated the
requirement for the LACCD to hold run-off elections if no
candidate for a seat on the LACCD board received a majority of
the votes in the primary election. The Senate amendments
provide that this change in election procedure shall occur only
if the governing board of the LACCD adopts a resolution
approving this change. Because the LACCD is the sponsor of this
bill, it is anticipated that the governing board will adopt such
a resolution. In light of this fact, this bill, as amended in
the Senate, is consistent with Assembly actions.
