BILL ANALYSIS Ó SB 133 Page 1 Date of Hearing: July 6, 2011 ASSEMBLY COMMITTEE ON APPROPRIATIONS Felipe Fuentes, Chair SB 133 (Wolk) - As Amended: April 5, 2011 Policy Committee: Natural ResourcesVote:9-0 Urgency: No State Mandated Local Program: Yes Reimbursable: No SUMMARY This bill extends the sunset date allowing use of the Cache Creek Resources Management (CCRM) Plan as the functional equivalent of a reclamation plan. Specifically, this bill: 1)Extends, from December 31, 2012, to December 31, 2017, the date at which the CCRM Plan, in conjunction with a site specific plan deemed by the appropriate lead agency as consistent with the CCRM Plan, shall be considered a functional equivalent of a reclamation plan for purposes of the Surface Mining and Reclamation Act (SMARA). 2)Requires the annual Cache Creek Area Plan report, prepared by Yolo County, to be submitted to the Assembly Natural Resources Committee and the Senate Natural Resources and Water Committee. 3)Deletes the existing requirement that conditions use of the CCRM Plan as the functional equivalent of a reclamation plan upon notification by the State Mining and Geology Board that it has approved an ordinance adopted by the Yolo County Board of Supervisors. FISCAL EFFECT Negligible state costs. COMMENTS 1)Rationale . This bill's sponsor, Yolo County, contends that SB 133 Page 2 provisions allowing a site specific plan adopted under the CCRM Plan to act as a functional equivalent of a SMARA reclamation plan need to be reinstated to allow the county to continue to move forward with necessary seasonal extraction activities. 2)Related Legislation . AB 297 (Thompson, Chapter 869, Statutes of 1999) authorized Yolo County to use, until December 31, 2003, the CCRM Plan as an alternative to a reclamation plan. AB 1984 (Wolk, Chapter 173, Statutes of 2004) extended this sunset until December 31, 2008. AB 646 (Wolk, Chapter 604, Statutes of 2007) extended the sunset until December 31, 2012.
