BILL ANALYSIS Ó SB 303 Page 1 Date of Hearing: July 13, 2011 ASSEMBLY COMMITTEE ON APPROPRIATIONS Felipe Fuentes, Chair SB 303 (Padilla) - As Amended: July 11, 2011 Policy Committee: HealthVote:19 - 0 Urgency: Yes State Mandated Local Program: Yes Reimbursable: No SUMMARY This bill clarifies that existing law requiring a food handler to obtain a food handler card only applies to food handlers employed at a food facility that sells food for human consumption to the general public. In addition, this bill requires that after January 1, 2012, a food handler must obtain a food handler card exclusively from a nationally accredited training provider. Finally, the bill clarifies that snack bars, prisons and county jails, and elderly nutrition programs are exempt from the food handler certification requirements. FISCAL EFFECT There are no significant costs associated with this legislation. COMMENTS 1)Rationale . This bill is intended as clean up legislation for last year's SB 602 (Padilla; Chapter 309, Statutes of 2010). Specifically, this bill is intended to clarify that food handlers are required to get a certification card from a provider accredited by the American National Standards Institute (ANSI) and to clarify which types of eating establishments are required to have certified food handlers. 2)Related Legislation . SB 602 requires food handlers, with SB 303 Page 2 specified exceptions, to obtain a card after taking a food safety training course and passing an assessment beginning on June 1, 2011, and mandates at least one of the accredited food safety certification examinations required under current law to be offered online.
