Assembly Amendment s correct a drafting error in a statute dealing with the rights of the legal owner of a vehicle CONTINUED SB 565 Page 2 that has been impounded, clarify that a local authority may enforce restrictions against the fraudulent use of disabled placards in any and all parking spaces, provide that a repossessor is not required to pay delinquent registration fees on an impounded vehicle as specified, require a transit bus operated by a motor carrier that provides public transportation services to be equipped with a speedometer that is maintained in good working order, and modify the current state transit assistance operator eligibility. ANALYSIS : Existing law requires the clerk of the court to collect a fee from a person ordered or permitted by the court to attend a traffic violator school and authorizes the clerk to accept a payment of at least 10 percent of a specified amount upon filing a written agreement by the defendant to pay the remainder of the fee according to an installment payment schedule of no more than 90 days as agreed upon with the court. This bill: 1.Corrects a drafting error in a statute dealing with the rights of the legal owner of a vehicle that has been impounded. 2.Clarifies that a local authority may enforce restrictions against the fraudulent use of disabled placards in any and all parking spaces. 3.Provides that a repossessor is not required to pay delinquent registration fees on an impounded vehicle, provided the vehicle is to be towed to an auction for resale at which time the delinquent fees will be collected and remitted to the Department of Motor Vehicles. 4.Requires a transit bus operated by a motor carrier that provides public transportation services to be equipped with a speedometer that is maintained in good working order. 5.Modifies the current state transit assistance operator eligibility standards by extending the current efficiency CONTINUED SB 565 Page 3 criteria exemption from fiscal year 2011-12 to fiscal year 2014-15. 6.Corrects a chaptering-out error that occurred when two bills last year - SB 857 (Budget and Fiscal Review Committee), Chapter 720, Statutes of 2010, and AB 2499 (Portantino), Chapter 599, Statutes of 2010 - both amended Vehicle Code Section 42007. 7.Includes provisions to avoid inadvertently chaptering out AB 1298 (Blumenfield), a bill dealing with mobile billboards displayed on parked vehicles.
