   An act to amend  Sections 5821 and 5826  
Section 5827  of the Public Resources Code, relating to parks.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 685, as amended, Evans. Parks: Mendocino Woodlands Outdoor
Center
   The Mendocino Woodlands Outdoor Center Act requires the Department
of Parks and Recreation to administer as a unit of the state park
system the Mendocino Woodlands Outdoor Center.  The act finds
that the location and facilities of the center are well suited to
serve as an outdoor education center.  
   This bill would also include in these findings that the natural
resources of the center make it well suited to serve as an outdoor
education center.  
   The act requires the department to consult with the Department of
Education and authorizes the department to cooperate with any
individuals or agencies that have jurisdiction or expertise in
matters pertaining to outdoor education.  
   The bill would also authorize the department to cooperate with the
Department of Education on matters pertaining to outdoor education.
 
   The act authorizes the department to enter into an operating
agreement with a qualified nonprofit entity. The act requires the
department, prior to entering into an agreement, to submit a copy of
the agreement to the Legislative Analyst for his or her review and
recommendations. The act provides that the proposed agreement is
deemed to constitute the Legislative Analyst's approval if the
Legislative Analyst fails to respond within 30 days after submission.
 
   This bill would instead provide that the proposed agreement is
deemed to constitute the Legislative Analyst's approval if the
Legislative Analyst fails to respond within 30 days after submission.

   Vote: majority. Appropriation: no. Fiscal committee:  yes

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 5827 of the   Public
Resources Code   is amended to read: 
   5827.  The department may enter into  an  operating
 agreements   agreement  with  any
  a  qualified, nonprofit entity for the provision
of  any   a  program or service
contemplated in this chapter. Prior to entering into  any
such   an  agreement, the department shall submit a
copy of the proposed agreement to the Legislative Analyst for his
 or her  review and recommendations, which shall not,
however, be binding. Failure of the Legislative Analyst to respond
within  30   90  days after submission of a
proposed agreement shall be deemed to constitute approval by the
Legislative Analyst of the proposed agreement. 
  SECTION 1.    Section 5821 of the Public Resources
Code is amended to read:
   5821.  The Legislature finds that there is need for a program to
enable the children of the state to better comprehend the outdoors,
particularly the social and economic importance of the study,
conservation, protection, and utilization of natural resources. The
Legislature further finds that the locale, natural resources, and
facilities of the Mendocino Woodlands Outdoor Center are especially
well suited to serve primarily as an outdoor education center under
the control and management of the Department of Parks and Recreation,
as a unit of the state park system.  
  SEC. 2.    Section 5826 of the Public Resources
Code is amended to read:
   5826.  The department shall consult with the Department of
Education, and may cooperate with the Department of Education,
individuals, and agencies having jurisdiction or expertise in matters
pertaining to the outdoor education programs contemplated in this
chapter.
