          SUBJECT  :   Professions and vocations: regulatory boards. 

           SUMMARY  :   Extends the sunset dates for various professional 
          boards under the Department of Consumer Affairs (DCA) and makes 
          technical and clarifying changes.  Specifically,  this bill  :   

          1)Extends the sunset date for investigation provisions under the 
            Medical Practice Act from January 1, 2013 to January 1, 2014.

          2)Extends the sunset date for the Naturopathic Medicine 
            Committee under the Osteopathic Medical Board of California 
            from January 1, 2013 to January 1, 2014; 

          3)Extends the sunset date for the Physical Therapy Board (PTB) 
            and the term of its executive officer (EO) from January 1, 
            2013 to January 1, 2014; 

          4)Extends the sunset date for the Board of Pharmacy (BOP), the 
            BOP appointment authority, and the term of its EO from January 
            1, 2013 to January 1, 2017; 

          5)Extends the sunset date for the Court Reporters Board (CRB), 
            the term of its EO, and specified Transcript Reimbursement 
            Funds (TRF) from January 1, 2013 to January 1, 2017.  

          6)Extends the sunset date for provisions relating to the 
            vertical enforcement and prosecution model of medical 
            misconduct from January 1, 2013 to January 1, 2014. 

          7)Makes technical and clarifying changes within the Business and 
            Professions Code. 

           EXISTING LAW  provides for various boards, bureaus and commission 
          in the DCA to establish minimum qualifications and levels of 
          competency and license persons desiring to engage in the 
          occupations they regulate, and sunsets those bodies and their

          functions on certain dates unless further legislation is enacted 
          to delete or extend those dates.

           FISCAL EFFECT  :   Unknown

           COMMENTS  :   

           Purpose of this bill  .  According to the author's office, this 
          bill seeks to extend the sunset dates for various boards and 
          makes technical and clarifying changes. 

           Support  .  According to the CRB, "This bill would extend the 
          sunset date of the CRB to January 1, 2017.  Additionally, the 
          bill extends the date for the EO position to January 1, 2017.  
          ÝThis bill] also extends the sunset date for the TRF, which has 
          been in existence since 1981, helping qualified indigent 
          litigants of California gain increased access to the justice 
          system." 

          According to the BOP, "This bill would extend the BOP's sunset 
          date for four years." 

          According to the Healthcare Distribution Management Association, 
          "The BOP regulates the acquisition, storage, distribution, and 
          dispensing of pharmaceuticals.  The thirteen-person BOP, the 
          five policy committees, and the BOP staff review licensure 
          applications, inspect wholesale distribution facilities, and 
          issue permits required to operate in California.  As a result, 
          the BOP ensures wholesalers meet the necessary requirements to 
          perform their duties and maintain a safe and efficient supply 
          chain." 

           Related Legislation  .  SB 1236 (Price) of 2012, extends the 
          sunset dates of the California Board of Podiatric Medicine and 
          the Physician Assistant Committee and makes other changes, as 
          specified.  This bill is pending in Assembly Business, 
          Professions and Consumer Protection Committee. 

          SB 1238 (Price) of 2012, extends the sunset date of the Board of 
          Psychology and the Board of Behavioral Sciences and extends 
          their authority to appoint an EO.  This bill is pending in 
          Assembly Business, Professions and Consumer Protection 
          Committee.

          SB 1239 (Price) of 2012, extends the sunset date for the

          Acupuncture Board and the term of the Acupuncture Board's EO by 
          two years, until January 1, 2017, and makes technical and 
          clarifying changes.  This bill is pending in Assembly Business, 
          Professions and Consumer Protection Committee.
