An act to amend Section 152 of the Labor Code, relating to
employment.
LEGISLATIVE COUNSEL'S DIGEST
SB 1440, as introduced, De León. Division of Labor Statistics and
Research.
Existing law establishes the Division of Labor Statistics and
Research for purposes of, among other things, collecting, compiling,
and presenting facts and statistics relating to the condition of
labor in the state. Existing law provides specified powers and duties
to the chief of the division.
This bill would make technical, nonsubstantive changes to these
provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 152 of the Labor Code is amended to read:
152. The Chief of the Division of Labor Statistics and Research
and employees of the division authorized by him or her may
issue subpoenas to compel the attendance of witnesses and production
of books, papers , and records; administer oaths; examine
witnesses under oath; take the verification or proof of written
instruments; and take depositions and affidavits for the purpose of
carrying out the provisions of this code and performing the duties
which the division is required to perform. They shall have free
access to all places of labor. Any person, or agent or officer
thereof, who willfully neglects or refuses to furnish statistics
requested by the division, which are in his or her
possession, or under his or her control, or who refuses to
admit the chief or his or her authorized employee to a
place of labor, is guilty of a misdemeanor. The Director of
Industrial Relations may direct the chief and the employees of other
divisions of the department to transmit to the Division of Labor
Statistics and Research any statistical information in their
possession, or to conduct investigations and otherwise assist the
Division of Labor Statistics and Research in the gathering of
whatever statistics the director deems desirable.
