An act to amend Section 5502 of the Public Resources Code,
relating to park districts.
LEGISLATIVE COUNSEL'S DIGEST
SB 1459, as introduced, De León. Regional and local park
districts: cities and counties.
Existing law prescribes procedures for the formation of regional
park districts, regional park and open-space districts, or regional
open-space districts. Existing law authorizes 3 or more cities,
together with any parcel or parcels of city or county territory,
whether in the same or different counties, to organize and
incorporate, but requires that all the territory in the proposed
district be contiguous.
This bill would revise the above authorization to instead only
allow district formation for 4 or more cities.
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 5502 of the Public Resources Code is amended to
read:
5502. (a) Three Four or more
cities, together with any parcel or parcels of city or county
territory, whether in the same or different counties, may organize
and incorporate. All the territory in the proposed district shall be
contiguous.
(b) Notwithstanding subdivision (a), one or more cities, together
with any parcel or parcels of city or county territory, whether in
the same or different counties, the territory of all of which when
combined has a population of at least 50,000, may organize and
incorporate. All the territory in the proposed district shall be
contiguous.
