BILL ANALYSIS Ó SB 1578 Page 1 Date of Hearing: June 20, 2012 ASSEMBLY COMMITTEE ON GOVERNMENTAL ORGANIZATION Isadore Hall, Chair SB 1578 (Committee on Governmental Organization) - As Introduced: March 20, 2012 SENATE VOTE : 37-0 SUBJECT : State Treasurer SUMMARY : Makes clarifying changes to outdated provisions of law relating to the State Treasurer's Office (STO) in order to modernize its business practices. Specifically, this bill : 1)Removes the STO's authority to appoint certain officers. 2)Eliminates the powers and authority granted to certain employees of the STO. 3)Requires the STO to be kept open for business from 8 a.m. until 5 p.m. unless otherwise provided by law. EXISTING LAW 1)Requires the STO to, among other things, receive and keep in the vaults of the STO or deposit in banks or credit unions all moneys belonging to the state, keep an account of all moneys received and disbursed, and report daily to the California State Controller the amounts disbursed during the preceding day and the funds out of which disbursements were paid. 2)Authorizes the STO to appoint as civil executive officers: one cashier, one bond officer, one deposit officer, one vault officer, one principal accountant, one bookkeeper, and one secretary stenographer. 3)Grants certain employees of the STO office when performing assigned duties, as specified, with the powers and authority conferred by law upon peace officers. 4)Requires the STO to close at 4:00 p.m. FISCAL EFFECT : Unknown SB 1578 Page 2 COMMENTS : Purpose of the bill : This bill deletes provisions in current law that impacts the STO. The current provisions are not consistent with STO business practices. This bill is necessary to avoid any conflicts that could arise if STO staff follows current law. Arguments in Support : The provisions that this bill seeks to delete were relevant when the STO operated like a bank and actually had a "teller" window. For example, the bill deletes language that permits the STO to close at 4 p.m. Since cashing services are no longer available, the STO remains open until 5:00 p.m. The deletion of this language would make the law consistent with actual STO practice. In addition, the STO claims that, "Section 2 deletes specific job classification language that is obsolete. Section 3 and 4 would remove provisions allowing STO employees who perform guard or messenger duties the same powers and authority conferred by law upon peace officers in both the Government Code and Penal Code Sections. This statute was relevant when the "bank teller" window was active and messengers were transporting cash in and out of the building. Further, my office does not employ peace officers and we see no reason going forward to require peace officers status for any employee of our office."
