SUBJECT : Nonresident tuition exemption: veterans

DIGEST : This bill extends, to a California State University
(CSU) undergraduate student, provisions exempting a California
Community College (CCC) student, who was a member of the Armed
Forces stationed in this state on active duty for more than one
year immediately prior to receiving an honorable discharge, from
paying nonresident tuition for up to one year while providing
the student up to two years following discharge to use this
exemption, if the student files an affidavit stating their
intent to establish California residency as soon as possible.
This bill requests the University of California (UC) to also
adopt the same requirement as the CSU and CCC.

ANALYSIS :
Existing law:
1.Requires a student who was a member of the Armed Forces
stationed in California on active duty for more than one year
immediately prior to being discharged to be exempt from paying
nonresident tuition for the length of time he or she lives in
the state, up to the minimum time necessary to become a
resident. In addition, current law provides, for purposes of
CCC fees, a former member of the Armed Forces can utilize the
one-year nonresident fee exemption within two years of being
discharged provided the former member of the Armed Forces has
filed an affidavit with the CCC stating his/her intention to
establish residency in California as soon as possible.
2.Establishes uniform residency requirements for purposes of
ascertaining the amount of fees to be paid by students at UC,
CSU, and CCC, and establishes various exceptions to these
residency requirements, including the following:
A. A member of the Armed Forces who is stationed in the
state on active duty, except a member assigned for
educational purposes.
B. A member of the Armed Forces who is transferred to
another state but continuously enrolled at a college in
California.
C. A student who is a dependent of a member of the Armed
Forces stationed in this state on active duty.
D. A student dependent of a member of the Armed Forces may
keep his or her resident classification until he or she has
resided in the state for the minimum time necessary to
become a resident in the event the member of the Armed
Forces upon whom they are dependent is transferred outside
of the state or retires as an active member of the Armed
Forces.
This bill:
1.Extends, to a CSU undergraduate student, provisions exempting

paying nonresident tuition for up to one year while providing

2.Requests the UC to also adopt the above policy.

According to the Senate Appropriations Committee, the cost of
this bill's nonresident tuition exemption for all veterans
discharged or released within the immediately prior year will
depend upon the number of veterans that choose to utilize the
new exemption each year. This bill is likely to result in
significant revenue losses to the CSU, the UC, and the CCC.
UC: Annual revenue loss of approximately $1 million for
undergraduate student exemptions.
CSU: Annual revenue loss of nearly $2 million for
undergraduate student exemptions.
CCC: Annual revenue loss likely in excess of $2 million.
Mandate: Likely minor reimbursable mandate on community
college districts to change verification policies and
procedures in compliance with this bill.
