SUBJECT : Nonresident tuition exemption: veterans

DIGEST : The bill authorizes the California Community Colleges
(CCC), California State University (CSU), and the University of
California (UC) to exempt from paying nonresident tuition a
student or prospective student of their respective segments who
is a former member of the Armed Forces of the United States, who
has been discharged from active duty, and who is using, or is
intending to use, "GI Bill" education benefits, as specified.
Senate Floor Amendments of 9/6/13 authorizes the CCC, CSU, and
UC to exempt from paying nonresident tuition, a student who is a
former member of the Armed Forces of the United States

irrespective of where they reside or were stationed, and who has
been discharged from active duty, and who is using, or intends
to use "GI Bill" education benefits while enrolled as a student
of that segment, as specified.
ANALYSIS :
Existing law:
1.Requires a student who was a member of the Armed Forces
stationed in California on active duty for more than one year
immediately prior to being discharged to be exempt from paying
nonresident tuition for the length of time he/she lives in the
state, up to the minimum time necessary to become a resident.
In addition, current law provides, for purposes of CCC fees, a
former member of the Armed Forces can utilize the one-year
nonresident fee exemption within two years of being discharged
provided the former member of the Armed Forces has filed an
affidavit with the CCC stating his/her intention to establish
residency in California as soon as possible.
2.Establishes uniform residency requirements for purposes of
ascertaining the amount of fees to be paid by students at UC,
CSU, and CCC, and establishes various exceptions to these
residency requirements, including the following:
A. A member of the Armed Forces who is stationed in the
state on active duty, except a member assigned for
educational purposes.
B. A member of the Armed Forces who is transferred to
another state but continuously enrolled at a college in
California.
C. A student who is a dependent of a member of the Armed
Forces stationed in this state on active duty.
D. A student dependent of a member of the Armed Forces may
keep his/her resident classification until he/she has
resided in the state for the minimum time necessary to
become a resident in the event the member of the Armed
Forces upon whom they are dependent is transferred outside
of the state or retires as an active member of the Armed
Forces.

This bill:
1.Authorizes the CCC, CSU, and UC to exempt from paying
nonresident tuition a student or prospective student of their
respective segments who is a former member of the Armed Forces
of the United States, who has been discharged from active
duty, and who is using, or is intending to use, "GI Bill"
education benefits, as specified.
2.Makes a one-year exemption from payment of nonresident tuition
at a campus of the CCC, or as an undergraduate at a campus of
the CSU, or as an undergraduate at a campus of the UC, who was
a member of the Armed Forces of the United States stationed in
this state on active duty for more than one year immediately
prior to being discharged if he/she files an affidavit with
the institution at which he/she is enrolled, or intends to
enroll, stating that he/she intends to establish residency in
California as soon as possible, and uses this exemption within
two years of being discharged.

Local: Yes
According to the Senate Appropriations Committee, the cost of
this bill's nonresident tuition exemption for all veterans
discharged or released within the immediately prior year will
depend upon the number of veterans that choose to utilize the
new exemption each year. This bill is likely to result in
significant revenue losses to the CSU, the UC, and the CCC.
UC: Annual revenue loss of approximately $1 million for
undergraduate student exemptions.
CSU: Annual revenue loss of nearly $2 million for
undergraduate student exemptions.
CCC: Annual revenue loss likely in excess of $2 million.
Mandate: Likely minor reimbursable mandate on community
college districts to change verification policies and
procedures in compliance with this bill.
