P1 1WHEREAS, The privacy of personal information is a global
2imperative for governments, industry, civil society, and individuals;
3and
4WHEREAS, “Privacy” is the recognition that a free and
5democratic society respects the autonomy of individuals to choose
6the circumstances and degree to which individuals will expose
7their personal characteristics, attitudes, and behavior; and
8WHEREAS, Advances in modern technology enhance our lives
9by increasing our ability to communicate, learn, share, and produce,
10and that every effort should be made to continue both the creation
11and innovative use of such technologies; and
12WHEREAS, The growing use of technology in our everyday
13lives and in our work gives rise to a potential loss of personal
14privacy if appropriate attention is not given to the collection, use,
15and protection of personal information; and
16WHEREAS, Many individuals are unaware of the risks to
17privacy posed by new technologies, unaware of data protection
18and privacy laws generally, and unaware of specific steps that they
19can take to help protect their personal information; and
20WHEREAS, A continuing examination and increase in
21understanding of the ways in which personal information is
22collected, used, sorted, stored, shared, and managed in an
23increasingly networked world will contribute to the protection of
24personal privacy; and
P2 1WHEREAS, It is important for all Californians to be aware of
2the need for privacy protection and responsible data management;
3and
4WHEREAS, The California Constitution expressly protects an
5individual’s right to privacy from both governmental and private
6actors; and
7WHEREAS, Data Privacy Day constitutes an international
8collaboration and a nationwide and statewide effort to raise
9awareness about data privacy and the protection of personal
10information; and
11WHEREAS, The theme of Data Privacy Day is “Respecting
12Privacy, Safeguarding Data and Enabling Trust”; and
13WHEREAS, Government officials from the United States,
14Canada, and Europe, privacy professionals, academic communities,
15legal scholars, representatives of businesses and nonprofit
16organizations, and others with an interest in data privacy issues
17are working together on this date to further the discussion about
18data privacy and protection; and
19WHEREAS, The Privacy Enforcement and Protection Unit at
20the California Department of Justice, which exemplifies
21California’s commitment to enforce state and federal privacy laws,
22empowers Californians by helping them learn their privacy rights
23and strategies for protecting their privacy, promoting safer online
24behavior, and encouraging businesses and other organizations to
25follow best practices that respect privacy; and
26WHEREAS, Data Privacy Day will encourage more people in
27California to learn about technology and the tools available to
28assist them in controlling their own privacy, addressing data
29privacy concerns, and adopting best practices to protect their
30personal information; and
31WHEREAS, Parents, guardians, and educators in schools and
32universities across the country are being encouraged to take the
33time to discuss privacy and data protection issues with teens and
34young adults; and
35WHEREAS, Leading technology sectors can continue to serve
36as engaged and valuable partners in efforts to respect consumer
37privacy; and
38WHEREAS, Striking a balance between privacy, technology,
39and innovation can have a tremendous benefit to our society; now,
40therefore, be it
P3 1Resolved by the Assembly of the State of California, That the
2Assembly declares January 28, 2014, as California Data Privacy
3Day, to increase awareness of privacy and data protection issues
4among consumers, organizations, and government officials; and
5be it further
6Resolved, That the Chief Clerk of the Assembly transmit copies
7of this resolution to the author for appropriate distribution.
