House Resolution No. 27—Relative to California Data Privacy Day.

P1    1WHEREAS, The privacy of personal information is a global
2imperative for governments, industry, civil society, and individuals;
3and

4WHEREAS, “Privacy” is the recognition that a free and
5democratic society respects the autonomy of individuals to choose
6the circumstances and degree to which individuals will expose
7their personal characteristics, attitudes, and behavior; and

8WHEREAS, Advances in modern technology enhance our lives
9by increasing our ability to communicate, learn, share, and produce,
P2    1and that every effort should be made to continue both the creation
2and innovative use of such technologies; and

3WHEREAS, The growing use of technology in our everyday
4lives and in our work gives rise to a potential loss of personal
5privacy if appropriate attention is not given to the collection, use,
6and protection of personal information; and

7WHEREAS, Many individuals are unaware of the risks to
8privacy posed by new technologies, unaware of data protection
9and privacy laws generally, and unaware of specific steps that they
10can take to help protect their personal information; and

11WHEREAS, A continuing examination and increase in
12understanding of the ways in which personal information is
13collected, used, sorted, stored, shared, and managed in an
14increasingly networked world will contribute to the protection of
15personal privacy; and

16WHEREAS, It is important for all Californians to be aware of
17the need for privacy protection and responsible data management;
18and

19WHEREAS, The California Constitution expressly protects an
20individual’s right to privacy from both governmental and private
21actors; and

22WHEREAS, Data Privacy Day constitutes an international
23collaboration and a nationwide and statewide effort to raise
24awareness about data privacy and the protection of personal
25information; and

26WHEREAS, The theme of Data Privacy Day is “Respecting
27Privacy, Safeguarding Data and Enabling Trust”; and

28WHEREAS, Government officials from the United States,
29Canada, and Europe, privacy professionals, academic communities,
30legal scholars, representatives of businesses and nonprofit
31organizations, and others with an interest in data privacy issues
32are working together on this date to further the discussion about
33data privacy and protection; and

34WHEREAS, The Privacy Enforcement and Protection Unit at
35the California Department of Justice, which exemplifies
36California’s commitment to enforce state and federal privacy laws,
37empowers Californians by helping them learn their privacy rights
38and strategies for protecting their privacy, promoting safer online
39behavior, and encouraging businesses and other organizations to
40follow best practices that respect privacy; and

P3    1WHEREAS, Data Privacy Day will encourage more people in
2California to learn about technology and the tools available to
3assist them in controlling their own privacy, addressing data
4privacy concerns, and adopting best practices to protect their
5personal information; and

6WHEREAS, Parents, guardians, and educators in schools and
7universities across the country are being encouraged to take the
8time to discuss privacy and data protection issues with teens and
9young adults; and

10WHEREAS, Leading technology sectors can continue to serve
11as engaged and valuable partners in efforts to respect consumer
12privacy; and

13WHEREAS, Striking a balance between privacy, technology,
14and innovation can have a tremendous benefit to our society; now,
15therefore, be it

16Resolved by the Assembly of the State of California, That the
17Assembly declares January 28, 2014, as California Data Privacy
18Day, to increase awareness of privacy and data protection issues
19among consumers, organizations, and government officials; and
20be it further

21Resolved, That the Chief Clerk of the Assembly transmit copies
22of this resolution to the author for appropriate distribution.
